You had already been clocked when you saw him. I did that for 25 years on four wheels.

OP. 92677? Laguna Nigel? SJC? DP? Somewhere round there. I worked those areas for most of the 1990s before retiring. And not as a CHP, thank god. Provide a few more details on where this occurred. What hwy, what lane, what direction. Time of day. If something stands out, I'll be happy to try and help.

So you Judge his speed approaching you at 90+ mph and feel a professional traffic enforcement officer couldn't have judged your speed..... Hmmm

The officer doesn't have to be in the lane directly behind you to clock you. If the officer was closing on you at 90mph+, you were probably driving at 75mph+.

Inaccuracy is inaccuracy, but is that grounds to not be cited for the ticket? Could be. I had a guy working for me that thought he could beat a speeding ticket becasue the officer wrote "BLU" on the ticket for car color, but his car was black. That didn't work out well for him.
However I beat a non-moving violation ticket because the officer wrote "Bentley" on a ticket he placed on my 1970 Buick. A car which features the name "B U I C K" in a foot long chrome strip between the tail lights. The first inaccuracy for color was essentially a typo. The second inaccuracy was gross enough to seriously question just which car was guilty of the violation, a Bentley or a Buick. So my point is, if you can show a level of doubt about the officer's speed estimate that would make a court magistrate agree you weren't doing what the cop says you were, you have a reasonable chance. If all you have is a verbal from the cop that leads you to believe his only reason is a pace you feel he didn't make, maybe not. Reason: you sure saw him catching up. Does that mean he could not have matched speeds with you before you saw him? All he needs is roadside cues such as mile markers and the ability to count, and he doesn't need to be in your noticeable view to do it. He also could have paced cars you were steadily passing.

Its very easy to notice somebody doing 90+ when everybody is doing 65, but its harder to see somebody doing 75 in the same conditions

"3 over" what? 3 over 10 over (78 in a 65)? Busted! Pay up. If you know you did wrong... pay the fine and learn from the experience.

My question did this motorcycle unit follow "pace" you to judge your speed? Was the roadway flat or did it have hills and valleys? I am a cop so these questions are important to know to help answer your question. |
