I am gonna fight them tooth and nail for this!

You really have to push this and you may have to get your insurance involved. This isn't something they willingly give out.

If they give me any run arounds I swear it willl be the stupid cops I would be pissed at more than anyone else. I have to go make a police report within 5 days, so I may go do that today.

Keep calling the guys insurance company since it happened @ S&S at this point it's your word against his word and his insurance company may tell you to take a hike esp with no police report (even with a police report and he is found at fault in Florida it's a PITA my wife was rear ended on the FL Tpk a POS Saturn Vue rear ended her in our 1 year old Suburban, the driver had a suspended drivers license, it was not his car FHP let him go and on top of it his insurenace refused to pay no witnesses).

Your opther option is to sue the person take him to small claims court but the cost of all of this really not worth it. As others have said keep on your insurance company about the "Diminished Value Compensation".

On a positive note she will be good as new in a few weeks.

Sean

Yep. lol. Maybe I should've been going 155 in the stupid parking lot!

Sorry to hear what this idiot did to you, A few years ago I was in a grocery store parking lot driving a 4700 pound Dodge Ram, bright red and some jerk in a clunker Buick
backed into me, I got a new rear bumper and some paint, his was totaled.
He said he "didn't see me" !!!!

Unless you drive a M1A1 Abrahms tank, some idiot will come along and give you a pain in the rear!!!

Did Onstar tell you why they would not dispatch police to your collision which occurred on private property?

If Florida law is anything like California, the vehicle code is NOT your friend while driving on private property, including retail lots which are open to the public. Only a handful of vehicle laws can be enforced (DUI, reckless driving in retail lots,unlicensed/suspended drivers). In California, Stop sign and speed limits posted in private lots mean NOTHING. They are not enforceable and the police can't find someone at fault in a crash for ignoring them. There is no right of way and and nobody has to yield to anyone else. A car backing out of a stall does not have to yield to another vehicle passing behind them.

In CA, police will typically take collision reports on private property only when there is physical injury. Nonetheless, insurance companies look at these as 50/50 shared fault unless your vehicle is PARKED and unoccupied at the time of the collision. Driving in parking lots is risky. Pay your insurance. Too many of the other guys are uninsured.

This slays me. Private property my A**. If a person walks into a bank with a pistol and sticks up a private company - it is still a crime. Know what I mean. I get tired of hearing this crap. I mean are we the "UNITED STATES" or not! What is the difference between a STOP SIGN in Florida and a STOP SIGN in California = about 3,000 miles - that's it. I think the legal system allows such crap to CYA themselves and the insurance companies and nothing else. We need to make our elected officials get the laws right to protect "US". These differences in driving laws state to state are just dumb. A stop light is a stop light and a dumb a** is a dumb a** - regardless of state or nationality.

Oh yes, to ThisChicksGotAYellow2SS, I take it this note coming from a jail cell? I mean you did adjust this guys attitude and are just not telling us? You could have since you were on private property - FHP did tell you they couldn't do anything on private property !!!!! Sounds like permission to open a six pack of whoop a** to me.

Yeah, some dude in a mini van started backing up on me in the movie theater and the family was unloading. I got lucky and hit the horn with him maybe an inch away. I feel for you.
