Agree with the OPs decision to protect family and self. As someone that also serves (USN), I know what you mean about being armed here (I have a CCW for FL) and being over "there". Its more of an aggressive adrenaline rush here because you don't want things like that to happen, over there you almost anticipate it. I think you made a great choice being as the other person was armed. It would be no different if he had a knife.

I usually won't post in these threads but I have two thoughts:

1. You did what you had to do.

2. That is just about the most articulate, well written, grammatically correct post I think I've EVER read on the internet. GOD BLESS YOU SIR! And thank you for your service to this country.

I agree with your actions but in certain places that would be 'brandishing' and a crime.

Most places define 'brandishing' as a person exhibiting any deadly or dangerous weapon in a rude, angry or threatening manner. In this case I was justified as I drew my weapon after being confronted with a weapon that could have cause myself or my family bodily harm. By rapidly walking toward me the person displayed a want to cause me harm. Now if I would have merely raised my shirt up to show the fact that I was carrying, that would be brandishing. If I am walking down the street and my shirt blew up because of the wind and someone saw it, again brandishing. If the act of drawing a weapon in defense of oneself after being attacked was brandishing, there would be no CC allowed. Brandishing is a slippery slope. In my situation if the person would have just grabbed the piece of metal and stood by the truck and not approached me and I drew my weapon, yes I could have been charged with brandishing. Slippery slope.

Understood and I agree. But in some places, still...brandishing.

I posted not for your benefit, actually, but as a general- "good going but we all need to know our local laws" type of thing

First off, I am sorry this happened to you and your family. There is absolutely no excuse for this type of behavior. However, drawing your weapon in this situation seems a little much IMHO.
NOT AT ALL! A person with 21ft of you can close that distance before you have time to react. You were well within your rights of personal defense since he had a weapon.

Congrats and Proud to read your story. The courage to draw must have really been something.

In Kansas it's force upon force. Pretty sure it would have ended differently here. Even though I would have probably done the same.

Thank you for your service, it is greatly appreciated. I feel you were totally in the right to draw your weapon as you provided the opportunity for the aggressor to stand down.

This is text book of how to handle the situation, now if you had not had the gun, the perp would have probably had a piece of scrap metal sticking out of his fourth point of contact, I'm pretty sure. When I got my CHL, I also bought the insurance to be represented if I needed to use it, hopefully I never will, but I hope I am as cool under pressure as the OP was. And for those with dissenting opinions, I'd rather be judged by 12 than carried by 6, I refuse to be a sheeple or a victim, better to be a sheep dog... HOOAH!
