Rear-ended Camaro!!!!

My baby got rear ended while i was stopped at the light. What are the insurance laws?? Does his insurance pay for it??

Depends on your policy..

And I think in most states...someone runs into the back you..its automatically their fault. Even if its on the open highway.

The guy that hit you should have to pay the deductible on his own insurance policy.

Sorry for your loss. There seem to be lots of wrecked Camaro posts today. Sad day.

he pays 100% you might have to pay the deductable up front while your insurence goes after his buy you get it back, its better to expidite the repair then wait on the other guys company, and for a rear ending with the common amount of work, you can get the body shop to roll it in so you dont have to pay

Body shops that will "roll it in" IE: save you from paying your deductable, will in most cases short cut the repairs to your car. Where do you think the $500.00 or $1000.00 ded will come from ?- Not the shops bank account. It will come from an inflated estimate or the quality of the repairs to your new Camaro. Also, once the shop "saves" your deductable any shop warranty is out the window- Poor unibody repair, used parts, excessive bondo, etc- It's all on you.
Just a word of caution from a long time L.I/ N.Y.C. adjuster.

Not sure about NY but here in NJ, the person that "ended" you is responsible for everything. Little story here: my car got rear ended and the woman that did had a claim set up the very next day and all's i did was talk to her insurance person and then dropped my car off at the body shop and they took care of everything, i had to pay nothing. Not sure how NY works or if everybody gets the same shake. Sorry to hear and make sure they use all new parts, he is right above; some shops are instructed to use not so good quality parts and products! hell i would be right behind the car as they repair it! GL Sorry to hear.

i got to partly disagree there are some (not many) good shops out there that do the right thing but yes there are some real hacks out there

We've been in the bodyshop business since 1987, and in the early days there was alot of fraud in respects to adjusters taking bribes to inflate and estimate in order to hide the deductible. Remember though deductibles were small in comparision to todays deductibles. There is absolutely no bribing (at least in my area) of adjusters going on today and there is no way to "save" a persons $500 or $1000 dollar deductible.

In your case of being rear ended.....as long as the other party has valid insurance you should be able to put a claim in against their policy and get paid 100% for your damages and for the rental car. We do this for our customers all the time.

Same thing happened to me. I got rear ended at a red light also during rush our traffic. The lady's foot "slipped" off the brake and hit me at 10mph. Got to get an estimate on Monday and see if she wants to write a check or go through insurance.

Definitely 100 percent they gotta pay, I remember when I had my Third Gen I was sitting in a parking spot and some dude was speeding and hit me in the rear near the quarter panel. He literally put me on the sidewalk I was so angry when I called my insurance company they were like "Oh you gotta call his insurance they are gonna pay for it."

However I regret not just taking the check and junking the Third Gen had nothing but issues after she was repaired. Just watch out when the insurance guy is going over your car make sure you want everything new.
