Street Racing Death in Kodiak Alaska

Street racing can cost you your freedom. Story below


KODIAK, Alaska — A second man has been charged in a street-racing crash that left a Kodiak teenager dead.

Kodiak Police Chief T.C. Kamai tells KMXT-FM (http://bit.ly/a0fgrl) that 20-year-old Markryan Portillo was charged Monday with second-degree murder and felony assault.

Police say Portillo was driving the car in which 19-year-old Austin Long was riding when it crashed during an illegal race on the Fred Zharoff Memorial Bridge.

Long died when Portillo's car hit an oncoming pickup. Long's car had been bumped by a car driven by 19-year-old William Mecham. Police estimate the cars had reached 60 mph on the quarter-mile bridge to Near Island.

Mecham is charged with first-degree murder and driving under the influence.

Portillo suffered injuries in the crash that required a hospital stay. He remained jailed Tuesday.

First degree will never fly, they will have to lower it to man 2 if they want to convict.

With the DWI charge too, 1st degree homicide may indeed fly. By drinking/driving and being "legally" drunk it is assumed that you knowingly put the life and safety of others at risk and therefore a death resulting from a vehicular accident was premeditated...hence 1st degree. Likely though, the most he'll get convicted of is 2nd degree homicide or even the lesser charge of felony vehicular manslaughter.

They only reached 60mph? What were they racing? Ford Pinto's?

My bad.

But, to be honest, I only feel bad for the families involved. We all know the passenger that died was more than likely a willing participant that had way too much confidence in his buddy's driving abilities.

ya i'd sadly have to say the one who died probably knew and encouraged the race. so to pin murder on the driver is crazy. also as stated "By drinking/driving and being "legally" drunk it is assumed that you knowingly put the life and safety of others at risk and therefore a death resulting from a vehicular accident was premeditated" that's crazy. he knew even less what he was doing if drinking. to me that is 1 of many flaws in law if that would fly in court. that's insane actually jesus....

This is not street racing. This is kids acting completely irresponsible and getting hurt. By no means does this have anything to do with actually under ground racing. It should be labeled appropriately.

I'd have to disagree with your latter statement. I personally believe that if someone drinks and drives and then kills someone they should be charged as Murder 1. Because, they knew that they were unable to drive and therefore made the decision to do so, thereby putting every other driver on the roads life in danger. Don't drink and drive simple as that.

1000% agree. Jeebus people...it is not like it is a big secret that drag racing another car on an open street is dangerous. They have been talking about this stupidity since the 1940's! Add drinking to the equation and you have to ask the driver what he/she expected to be the outcome.
