And for the record I am not slamming the OPs particular incidence here. I'm with the OP 100% here as far as getting screwed by this dealer. I am merely slamming most of your idea that the dealer is legally obligated to give someone more than the value of the car. I hope he get's a new car. I think that would be MORE than fair and a good outcome. But they don't OWE him a new car. And I doubt that the OP thinks they do. (not possitive)
Should they give more than the value? Absolutely. Case by case of course but it's a decision that they get to make. But should they be liable to? Hell no. Their liability goes to the value. |

I did miss #933. Sorry that I spoke out of turn. I just know in my heart I would be sick if it happened to me or to any of my classic cars. Even having collector car insurance, the way the market dove in 08 and bounced a little, the insurance company will find a way to low ball you. You can never get your dream car back. Just a bad memory. I'll wait to see how this all plays out to decide.

Will not have too. Transfer any ownership of real property to someone you trust, wait 2 years file bankruptcy's. They wouldn't collect a penny, EVER! Get job, transfer real property back. It's done thousands of times a year across this country.

Jhoop: Your story is similar to a story from a friend of mine. He took his Maxima to a dealership for something simple several years ago and they dropped the car from the lift. They took him through a TON of changes but the end result was that he was never really made whole. The car had a ton of problems after that which neither Nissan nor the dealership remedied. In this case, I sincerely hope you are made 100% whole. |

I was a service manager for many years and have unfortunately had to deal with bullshit idiot techs who damage cars. Just because the dealer was closed doesn't mean they aren't responsible for the car because at the time of the damage it was signed over to the dealer. What if a random person has broken into the dealer and stole the car? this is NO DIFFERENT. The dealer and their insurance should be covering this in a 100% fashion. period.
