CHP pulled me over on the way to watch the Steelers and Falcons at the local pub. Window tint too dark. LOVED the car and wanted to know about it.

I pulled the windows down before he pulled me over.

I don't know why but at certain angles, the wheel gap for the rear seems exaggerated

There was a Sheriff's deputy in the tint shop with me. He went darker.

i thought tint was a secondary offense and that they cant pull you over solely for it? like you had to be doing something else to get pulled over then they can question you about your tint darkness? anybody have any insight?

Dunno. That's why he pulled me over - for the windows. Said the exhaust sounded good. Was really into the car. I got on it going onto the freeway. Maybe I buzzed by him at 70 or so.

It is going to vary by state and, possibly, by local jurisdiction.

Sometimes the car helps if the cop is into cars. I used to own a Cobra replica. The day I bought the car I was driving it back home without the proper plates or registration. I was stopped on the toll road by an Ohio State Trooper for doing 73 in a 70 mph limit. He came up to the car and told me the real reason he stopped me was to look my car over. At that point I would of probably let him drive it if he wanted to. He never asked asked for licence or registration and sent me on my way.

There is no such thing as primary or secondary offenses. However, there are varying offense levels that carry with them stricter penalties and consequences such as infractions -> misdemeanors -> felonies.

Anything that is listed as a statute in your state's vehicle code gives, by itself, probable cause for an officer to pull you over if you are in violation of that statute. So long as your state has a law against tinted windows, that law by itself is enough for the officer to pull you over and ticket you. It's all about the existence of probable cause for the stop. Violating any single statute creates enough probable cause for the stop. These stops are usually pretext stops however, meaning that the officer is using it as an excuse to see if he can get you for something bigger, like drugs or DUI or weapons. Know your rights and never consent to a search of your vehicle.

Now, what you're probably thinking of when you say secondary offenses is that your local law enforcement agency might have typical procedures they follow such as not pulling people over for minuscule things like tinted windows unless they're violating other, more serious laws such as speeding. That would be very nice of them if they have those kinds of courtesy procedures they follow, but as far as the law is concerned, violating any single statute is enough for the ticket.

He tried to see if I was drunk. I wasn't. So he wrote me a tint ticket and I won't say anything much on here about his attitude during the process, but it wasn't very nice.

Don't worry, if you were above the legal limit, a good attorney would be able to have that dismissed on the grounds that "its too cold to have your windows down" does not constitute an articulate reasonable suspicion of intoxication enough to justify a field sobriety test.

Cops like that don't get away with abusing their power to harass people.

Sorry but you are incorrect on the secondary offenses. There are such things. Maybe you are not as specialized in the law as you think.
