Well guys this bites the big one, Friday the 28th was my 6 month anniversary. Now it is the day that my front end got smashed. The woman in front of me was driving a 1996 suburban, i glanced over at a car passing like i normally do and im pretty sure she was on the phone so she slammed her breaks for the people in front of her. i saw NO brake lights whatsoever, my girlfriend looks up and hollars at me i slam my brakes and BLAM airbags deploy....we both went to the hospital but we are okay. i cant say the same for my precious though....

If her brake lights don't work she can be held at fault.
Glad to hear everyone is okay though. Hopefully the damage isn't bad and she can be fixed right up.

Most, ie. very, very high percentages of the time, the person that rear-ends another will be held at fault due to keeping enough of a following distance to allow for cases where it is noticed that the vehicle in front has a sudden change in speed, regardless of the state of the brake lights.

Local laws in that area may be such that such a condition could make it a no-fault situation, meaning each vehicle owner pays for their own damages.

Sucks to see that though. :(
