fault lays on whoever the hell the insurance decides to pawn it on. trying to describe traffic situations is a waste of time.

Guess what I think I am gona get the blame and I don't think its my fault I just need some advice how to handle the situation in a worst case scenario I dnt want to end up being accused of some one elses mistake you know what I mean

i can barely understand your post....but, if i read it correctly,
one guy was over taking two around a curve. the person doing the overtaking is ALWAYS the responsible party. on top of that, you don't overtake around a curve. the person doing the speed limit not changing lanes has right of way and should NOT have to avoid a collision. |

I was behind the driver no 1
This guy was over taking us both on the curve lane And in blink of a second the guy was on my blind spot That's where I could not see him That's how I hit him But I spoke to the cops they r pinning it on me told me it's ur faucet u hit the car I didn't wanted to argue I jus asked that a person is over speeding and he is over taking two cars in the curve lane is that ok? The cop goes to me Yes and no It does not matter how fast he was you hit the car! |

What we think won't make a difference. What the cop thinks won't make a difference. Most likely cars #2 and #3 will share fault, but the insurance companys will hash it out between them. That's what they are paid to do. As long as you are covered, let them do thier job and don't worry too much about it. As long as everyone is okay and the vehicles get fixed... heck, you might even be able to get some upgrades out of it. Stay positive!

If this was a two-lane road (one lane going each direction) and car number 3 went to pass both you and the guy in front of you, then he has no business just hanging out in your blind spot. Plus, if the road was curving, then it was more than likely a "no passing" zone. But judging by what the officer told you (after deciphering your coded messages) this was probably not the case.
So, I'm guessing that this was on a multi-lane highway, in which case anyone can overtake in the left lane all day long, even if it is in a curved section of the road. Either way, you need to pay a LOT more attention to your mirrors in the future. Whether or not someone was in your blind spot shouldn't matter if you pay attention to your surroundings at ALL times. ![]() As far as insurance goes, I don't know how it works in Canada. Here in Texas it's just a matter of the insurance companies figuring out the details. The driver pays the deductible and everything gets fixed. Your best bet is to just sit down with your insurance agent and have them walk you through the proccess.

Let me see if I can clean this up for the op. He wanted to pass the car in front of him when he saw another car quickly coming up on him from behind. So he decides that he didn't want to let that car pass them both. So he precedes to try to make his move thinking he had time to beat the car that was coming up to pass him. Well to make a long story short, he didn't have enough time to win. So, BOOM!!.

and u merged into the 3rd car, hitting them in the side, or you pulled out infront of them and they rearended you??
if it's the first case it's your fault the 2nd case it's their fault......if you rearend someone it's always your fault....atleast in the states anyhow
