I need a traffic attorney referral in los angeles
I'm hoping someone can get me in contact with a great attorney!
I received a ticket for 125mph even though I was not going that fast. The LA Airport motorcycle cop was way behind me and probably had to go that fast to catch up to me. The CHP eventually came but let the motor patrol cite me. I was on the 605N in the carpool lane driving through Whittier. Thanks in advance -Evan |

what does the ticket say? appear by.... The cite should just be a notice to appear which is a promise to take care of the ticket. How did the motor obtain your speed; radar, lidar or pace?

You need one of these. I got nailed going 101 in a 60. needless to say, it ended up being an $890 ticket.. and that was the reduced COST!!! Since my V1 radar, it's saved me 13 times.

radar detector would have done me no good as the officer was just driving home and "saw" me driving fast and guesstimated my speed to be 125mph.

Is that what he said? If so, take it to court. Even if it was radar/lidar he'd need to visually estimate and then confirm with the device.

First, ask for an extension THEN ask for Trial by written Declaration

You sure? A girl I work with got 4 speeding tickets in the last month and a half, all over 85mph in a 65, took all 4 to court and were all dropped because the officer didnt show up.

Not really.
The first appearance is the "arraignment", where you go to enter your plea. At that point if you plea not guilty, they set a court date and at that time send subpoenas to all involved. Typically the arraignment is within 30 days of the violation or if some courts are behind they'll extend to 60 days out. After the arraignment and the subpoenas are sent out sometimes its a few months after the original violation and I've even been subpoenaed after a year and at that point nobody will remember a stop. Just a little knowledge of the California traffic court system.

Man, 2 movers? So let me get this straight... LAPD Airport motor guesstimated you at 100+ and apparently you crossed the double yellows to get into the car pool lane (did he see you or just guessing again) and no plates front or rear... Be honest, how fast were you going? and did you cross the yellows to get into the HOV? Do you have plates or just not a front plate?

What does your driving record look like? This kinda determines your credibility...
And it sounds like he "paced" you, which in this situation is a point in your favor. What kind of training does he have pacing cars on the freeway? In the location box on the cite, does it say "N/B 605 whatever to whatever"? How far?? Was he able to determine your speed in a half mile at 125?? See what I'm getting at? Did the CHP officer who pulled you over say anything about your speed or what was the conversation there? Did he also pace you and did you pass him at some point or how and why did he get involved? How far back was the LAPD motor? What were the traffic conditions like? Did he have a clear unobstructed view of you when you entered the HOV lane? If it was 9 AM on a Monday morning, isn't it a little unreasonable that you could get to 100 MPH in traffic? We're trying to create doubt here and if the questions are good, you'll put him on the spot.

I'd do a trial by dec and be very articulate as to your actions. Admit speeding but put that you were slightly above the flow of traffic (80-85) but not 125. Say when your saw the LAPD motor and how far behind he was and again the traffic conditions and lighting. In this area is it a speed limit or a max speed? Big difference!! Prima facia is speed limit and at times it is safe to exceed the limit. As far as the HOV lane.. At what point does it start? Do your homework and have proof. Try google or something showing where it starts. If he's wrong or doesn't know when he writes his dec, point in your favor.
Spell everything out. EX: On month/day/year at approximately 8:15 PM, I was traveling N/B on 605, just north of Interstate 5 in the lane to the right of the carpool lane and slightly above the flow of traffic. The traffic was flowing at 80 MPH and was moderate to heavy during daylight/evening hours. I moved to the left lane (HOV) during the broken line segment to get around slowing traffic. I observed a motorcycle approximately 1,000 feet to the rear of my vehicle and approaching fast. As the motorcycle got closer, I then noticed the emergency lights activate. I activated my right turn signal and began to yield to the right. I stopped on the right shoulder of the freeway near the Wherever overcrossing. The officer approached my vehicle and asked for my information and said the reason for the stop was for going 125 and crossing into the HOV lane. I asked how he determined my speed and the officer replied "guesstimated"... and so on. The more you can articulate, the better..
