Lost value??

So I was rear ended this week and now have a right to go after the insurance of the party at fault for the lost value of my car.

Any and all info is greatly appreciated.
Just so we are all on the same page it's a 2011 2LT RS with 32k on it.

2011 with 32K miles your unlikely to get loss of value IMO. And even if you did it wouldn't be anywhere near 7-10K.

In PA. we can't sue for lost value when someone wrecks into us. Some states you can. I would start high and let them work you a little. Maybe even say to them that you really don't want to pay for a attorney and just want to work this out with them. Scare them a little. Good luck man!!!!

You will get between $1k-$1.5k not much more it's going to be a fight to get it good luck

With a whack that hard, you might be injured. Neck and back sore? That could add "diminished value" in the claim.

Watch what you write here, insurance investigators are looking at us all of the time.
I had a tranny issue with a 2006 G6 GTP 6 speed manual and GM agreed to swap for a brand new G6 with an auto tranny after 6 months of complaining and I used G6 Performance site to tell every one and get some suggestions...long story.
When I finished the deal I was confirmed that they where following my posts on G6 Performance site and they new all about my problem.

if your state has diminished value laws, insurance aint paying unless they do, the diminished value is set by the insurance company in almost every case.

Even if it is some states are different, there are different values depending on if they used all new parts or used parts, some states don't allow diminished if they are all new parts even.

you will need to research what if any diminished value laws apply to you before you even look at figures, just because the law is there doesn't mean it will help you at all.

they will send you a check, you may need to prod but they will.

in the end, if you are unsatisfied with what they are sending you, don't listen to anyone on this forum, contact a lawyer and pay the adviser fee to get the real scoop.

In Florida don't you have go have the car apprasied by a third party for the diminished value? I seriously doubt you would get anywhere near $7k. However that wreck looks like one where I wouldn't want it back - if not totaled then I would be trading it as soon as I got it back.

You don't suffer from diminished value until you sale or trade the car. As such many insurance companies and states won't allow diminished value claims until you do sale or trade it in and some have a time frame.

You can try for it but don't be surprised if you are denied. Also you don't set the amount lost. If they agree to pay they will have it appraised and pay you the difference. I've rarely seen a diminished value claim go over $3-$4k on a new car. With your very high miles I would suspect less than that.
