I've been trying, to get this resolved. I want to remain a Chevrolet owner that much I do know, its just that this shouldn't have happened. As long as I get what I originally asked for, I'll be fine. I've kept my cool, simply showed everyone respect because the last thing I want is for anyone to say I was in the wrong.

Keep in mind I live 2000 miles away but if that's what it takes to find a good dealership I will make the drive!

Hey at least that didn't sell you a "new Camaro" that was wrecked and didn't disclose it to you!
Me and her have been talking ever since the start of this. She's been so helpful. She gave me an option today which i'm heavily thinking about depending on what happens with this.

I would recommend walking into the NavyFed ASAP and talk to your representative and let them know you were misrepresented with the facts and what recourse you have available. I would also look into contacting the State Attorney's office about your experience. If you can get this matter wiped clean, I would wait until Spring to try again because you could probably get a better deal for a '13 since it will be at MY end, you'll have more of your original loan payed off, and save a little more for a down payment.
I thought about this, But I'm dead set on the 1LE. I could wait I suppose but the fact that I came this close, pulled the trigger only to realize that someone dropped the ball. Part of me feels like its mine, after all the buyers order was filled out and the last thing I left the dealership was saying that "It'll be here on the 26th".

The original dealer has documents with you and it's official right? You could easily have a lawsuit. So, maybe if that is mentioned they will get their act together.
They should have the documents unless they got rid of them? I do however kept my buyers order and other paperwork that was given to me.

Further, if the dealer knew that you were relying on the deal to your detriment (selling your stuff in anticipation of the deal being honored), you may have a detrimental reliance case too, but not nearly as strong as a breach of contract case. Unfortunately, this would takes months and you appear to be in a hurry, so I'd accept this as a lesson learned. Good luck.
Payment was given, they accepted it and it was left in there possession for 6 days. All I was required to give them was $381 in cash on my return from out of town once the car had been delievered which should have been on 26 December.

If for some reason the actual car can't be in my hands. I'll be happy with a similiar vehicle. I want to stay Chevy. This to me isn't a case where I hate the brand. I love the brand. I was in a situation which shouldn't have happened, period. I was the consumer who walked into the dealership, made a deal. Deal was signed, payment was handed over. Whatever issues the two dealerships I was unaware and frankly being the consumer its not really my business. I kept my promise, which was the check I handed to them. They didn't keep theres. I'm not asking for a free anything, I'm not bashing the dealer, I'm not acting crazy over it. I will gladly pay for it, but I'm willing to pay what me and what my buyer order said as I was financied for the VIN specific vehicle.

don't do this, you will be losing thousands possibly on tax breaks you get when you trade in the car, the crap the dealer told you about going to car max was horrible advice as well. Cash for the car factors in after tax, trade in before tax.....

Also I wasnt aware the 1LE was still a rare commodity, they cant order one for you at the price stated? All the orders done for the year or something?

Hopefully this chevy rep can make something happen before it is too late. You are being much more level headed about this than I would be but that may work against you..

So I'd like to say the issue has reached the District Regional department of Chevrolet. Ive also filed a compliant with BBB. Brandon which is a forum member that works for Chevrolet has been extremely helpful. BeckyD has offered her services if need be as well.

This is just an unfortunate situation that no one should have to go through. I'll hopefully find some sort resolution. I'll keep everyone updated on the situation as it progresses.

That is called ....breach of contract ....,and the law does not like when it happen .
Stay firm , be polite and respectfully listen to everyone that has something to say
from all corners .
The more you listen the better prepared you will be for when you have to say something .

I hope this works out for you. Having worked at a dealership in the past, trades suck. They should have stated on the buyers order that it was contingent on the dealer trade and taken a good faith deposit. $100 Other huge factor is that they did not contact you with updates regarding the car. Your loan from the credit union never should have come into play until the trade was complete.

Yeah, I've been polite and level headed throughout this entire ordeal. I didn't even know that all of this was even possible when making a transaction, everyone that I have spoken to have never heard/experienced this before so I do not know what to expect. What I do know is, I want to stay Chevrolet and I want to continue my efforts into acquiring a Camaro 2SS/RS 1LE. I have no bad blood through the company, but what I experienced is just unacceptable.

I totally agree on the bold parts. Neither of those happened unfortunately.

If that was the case I would have left the situation alone and moved on. But the way everything played out was that on Dec.20th I shook the hands of the finance manager and check was given to him along with paperwork being signed. Last words were "Congratulations", and I shook his hand. On my way out, I spoke to my salesman, and I said I'll see you when I get back from out of town.

Update:

I've recieved multiple calls from Chevrolet Customer Service and they are still trying to understand what exactly happened.

I found out that the dealership has been misleading and telling Chevrolet that I was suppose to come in on 31 December and order the 1LE which was never said. To make matters worse, I was 3-hours away on the 31 December so why they choose that day is beyond me? So when I heard that, I simply had nothing to say. And apparently they are trying to say, they sold me the car on a "What If" basis. I have never heard of selling cars on a "What If" basis. This has to be the all-time low for a dealership to make that claim. All they had to do was be honest with me from the beginning instead of trying to cover up the wrong in what they've done. The dealership also claims that they never had the car in there inventory. False advertisement, unethical business practices, the list goes on.

Well me being in the military, you always learned to document everything. I did just that. I took a video and took pictures of 1LE on there dealership website as proof because I knew they would try to say they never told me they sold it to me, etc. Needless to say I still have the buyers order as well and all sorts of documentation to support my claim.

I will say the Chevrolet Customer service reps have been a tremendous help (Brandon & Lucas). I'm not sure what will come of all this, but something must happen as this shouldn't of happened to me and shouldn't happen to any consumer, period.

Have you talked to your bank? You can just cancel the loan and they will pull the money back from the dealership. Like a credit card dispute.

Received another call from GM today, they received my fax which had pictures of the vehicle on the dealership site which the dealership was claiming they never had it on there inventory online.

Note to self, its always good to document everything and keep a record of it.

Update: I recieved a call today. And honestly I'm just appalled how the story seems to be unfolds.

The GM reps calls me and starts to tell me that the GM of the dealership and the District Regional sales manager from GM spoke and apparently the GM of the dealership tells him that I canceled my order through them and I declined on making a order of the car and physically spoke to the GM (the guy who never returned my phone call) about it.

I've tried to maintain the dealerships identity but after these lies, I just refuse to any longer. KOONS CHEVROLET/GMC/BUICK OF TYSONS CORNER, VA thank you for accepting my check, sold me a car which you never had possession of in the first place.

You are aware of my situation and honestly I really do hope someone looks into this more. KOONS CHEVROLET/GMC/BUICK OF TYSONS CORNER, VA will no longer have the support of many service members on my base. We live by 3 things, honor, courage and commitment you'd think the the dealership would take pride in there craft. I will be writing Krystal Koons whom is the President of the Koons Dealerships.

Check was in there possession, buyers order was completed, I was slated to make payments on Feb 10 2013. Check was retrieved by me once I found out they were lying and given back to NavyFed to stop my payments.

Its very unfortunate that you had to go through this. GM was contacted, I filed a compliant through the BBB as well as dealerrating.com. I will also be contacting Krystal Koons.

In the mean time I sought out another dealer Casey Chevrolet in Newport News, VA and purchased a BRM 2SS/RS 1LE and couldn't be any happier with there service. They understood my situation which was going on and gave me the same trade-in value with outstanding service. There were all scratching there heads as to why I had a buyers order but no car(which i still have as proof). The GM there was a former Marine so he knew what I was going through. Integrity goes a long way...
