Im in Houston area and have no cats either but my tuner tuned the ECM for this setup so no check engine light, my brother has similar setup on his Mazdaspeed3 and it passed emissions because the car reads no codes. FYI the sniffer is used on pre OBD2 cars(95) so anything after that gets only the scanner and if there is no codes set for higher pollution the car should pass unless you get a pesky inspector who will get on his belly to physically check for cats; tint will more likely keep you from passing since its easier to check.
