You ever work insurance claims? "lawyering up" without the need will just cost you 33 -40 percent, why would you want to give it away? No injuries = no need for an attorney.

Car is not a total loss, however, it does qualify for diminished value as long as the state where the accident occured allows for diminished value.

Too little knowledge about something is dangerous, I would suggest a little research into the subject matter.

Oh, and I almost forgot, civil court is the only way if you decide to sue, the only other option is criminal court and we may think the other driver participated in criminal activity for trashing an awesome car, unless he/she was drunk, on drugs or involved in some other illegal activity, it would never go there anyway. Stupid is not a criminal activity in this case.
