What I'm going to do is install two red "tail" lights real low in my back window and wire them to my side markers.
As long as my turn and brake signals remain red, with these lights in my window I should technically be street legal. You are allowed to have orange runners on the back of your car, which these could be argued are.
I still might get pulled over but I think I'd win in court (have before).
The flicker of course is not legal in any way, as we know, so that will be for special occasions.

Considering they aren't DOT approved, I'd imagine that they aren't legal in any state. Not trying to deter anyone - just saying.
On the same note though, I've been using my afterburner tail lights for almost 2 years and have never had an issue **knocks on wood**
