PQ: I think I'm on the same page as you. In this instance, the dealership AND the owner were both wronged. This service guy used his keys to access the dealership at an unsanctioned/unapproved time outside of normal or reasonably expected business hours. The dealership was CLOSED. In a very real way, the employee entered the property illegally to steal property the dealership was in possession of. The business carries insurance for just this type of situation. I don't think it can be argued that it's negligence of the dealership. It was negligence of one person who screwed the dealership AND the owner. The fact is, the dealership fired this guy right away, and the guy lives in a trailerpark, so he doesn't have any assets that are going to cover the loss for either the dealership OR the owner. SHOULD the dealership stand up and just bite the bullet. Absolutely. Is the owner ENTITLED to a new car? No. If this were Jiffy Lube, NOBODY would be demanding that Jiffy Lube replace a 2012 with a 2014.
