It sounds like part of the deal you made with them (verbal or otherwise) was it would be de-moded, they even had you take the car back to do it. If this is the case and although they should have checked things out before paying you for the vehicle, they can hold you to it. It also sounds like they will negate the deal if you don't. I would be checking up on my state's laws in regards to verbal contracts as well, in some states/cases they can be just as binding as a written contract.

That being said, I would de-mod the vehicle, disconnect the battery for at least 5-10 minutes, clear any/all codes and hope the CEL light goes and stays off. However, since you've had the car tuned, I would bet that if the CEL does go off, it doesn't stay off for long and you will also need to get it 'de-tuned'. Good luck.
