Well, yes, apparently according to my friends who drive, they all say I am not at fault. But you know, eitherway... the LADY can make up anything... and twist the story. Heck, you guys dont know if Im being honest either... but I wouldnt tell a lie to forums any way lol. Fingers crossed guys... fingers crossed.

All i know is, i wont be able to sleep tonight. I'll just keep replaying that accident over and over again. And yes Steve Dallas, I got that pit in the stomach lol. Hopefully when it comes back from the shop my car will look brand new. =D

Okay, I came back from the Insurance Adjuster today... she told me that the Other Driver (The older woman) DOESN'T ADMIT TO HAVING COME INTO MY LANE. I was "WHAT?". Wow... I guess im too naive... why didn't I think she would lie to get out of this situation. Eitherway, from the looks of it, theres a high possibility of a 50/50 at fault. But that sucks eitherway, I have to pay alot more insurance, lose my discounts... and I have to pay an estimated $1800 on my Bumper and Fender. Gosh... this is the worst feeling I have ever felt in a long time.

jagan323,
It appears she did have the right of way from your story. No matter what her turn signal showed.. You can never trust a turn signal. I make the mistake of putting on my turn signal too early sometimes getting to an intersection and I have people pull out in front of me as well. The turn signal is by no way a defense for you in this case. Just go to traffic school to get the points off your license and pay the fine. Ultimately just thank God you and her are alright and be more careful next time around.

Nothing in your story sounds unusual.

there's always someone driving around with the blinker on for no apparent reason.

BUT like you said, you got screwed over. be extra careful on the road.

most older people are on legal prescription drugs which have side effects which they do not care about. (like that sleeping pill Ambien that makes you forget things and hallucinate.)

once you leave your home in your car, anything can happen. ask anyone.

your surrounded by a sea of people who should not even be driving but somehow have a drivers license and a vehicle.

Just STEP IT UP a notch and drive EXTRA defensively. Like people who drive motorcycles. Assume the other driver is going to hit you. Stay a few steps ahead.

I know you feel bad enough, but how did you not see her cutting into your lane? In Houston, people never turn into their lanes (and rarely use their blinkers) so if I assume anything, it's that they will take the whole road to make their right or left turn. Where were you looking? It seems to me that if you were looking anywhere in front of you, you could have avoided it. I think it's clearly her fault, but I bet the insurance companies try to share it 50/50.

I don't know why anyone thinks he is at fault.... they both clearly made legal turns, and it was her illegal lane change that caused the accident. Of course if you can't prove she came into your lane your pretty much stuck with a 50/50, which sucks.

If there's anything I've taken away over the years of riding motorcycles it's that on the road, you should just assume that everyone is trying to kill you. I know since I got my bike licence (5 years ago now) my awareness in any vehicle is 100 times better. you notice driving habits, who is drifting and not paying attention. I'd highly recommend getting a bike licence even just to improve driving skills

Great advice! I had three close calls in one year I drove my bike... I became so worried about other drivers that I no longer enjoyed the rides, so I sold it.

this is technically correct... but you can NEVER assume that people will stay in their lane. here in ohio, even thought that's how you are SUPPOSED to turn (turn into the nearest lane), people 95% of the time turn into the wrong one. its super annoying, and i hate it. it slows down traffic, is unsafe and not smart. but, many people don't even know that law, much less abide by it.

whenever i turn left at the same time as a right-turner, i always watch them like a hawk, and always make sure i can stop or have some other escape route.

There both at fault lol. She's at fault for not staying in the lane closest to the curb and hes at fault for not yielding to traffic. I would say split this 50-50.

In a perfect world, both vehicles could turn at the same time and not worry. Left turns ALWAYS yield to oncoming traffic though. Whether she was suppose to turn directly into the right lane doesn't matter, we all see that happen all the time and most of us are guilty of ourselves. I do that 3 or 4 times a day. That being said, why even risk playing the "who turns first" game with anybody. Especially when your the "Left turn vehicle" and most especially when your in a new car.

Well honestly, I love my car, and i would NEVER risk it. I guess if i think back on it now, it was more like "I guess it will be safe". But i dont know anymore... all my memories are blurry. But no... My heart broke when i saw the damage to my Camaro man. I care about it. And from now on, I'll drive like a Chicken. lol

That sucks for sure, but insurance covers the damage right? Accidents happen bro, part of life, thankfully you weren't hurt and once the car is fixed it should look good as new.
