Well, right now, my brother and I and my brother-in-law and sister-in-law are all co-executors for our parents law suits and are going through this stuff with the death of 4 people thanks to a truck driver doing over twice the limit down a mountain. If the insurance company decides to fight, instead of paying out the coverages, can be held accountable for more than the limit. It is a bad faith claim that is filed with the claim. The owner can also be held responsible for additional money, if the insurance company pays out and the law suit with the owner is continued. At least this is what I understand from our attorneys.
I really hope this guy has good insurance and this elderly couple is able to collect something for their pain.

So what does the Camaro wrapped around the pole in the other thread do for Camaro drivers?

I wanted to ask the same thing but couldn't because, being a mustang owner, I would have been immediately labeled a troll.

Well, pfft... yeah, you are a troll. Anyone driving a Mustang is.

I think the guy you're referring to was joking (sarcasm). When people do stupid crap in your car they make you look bad. Is it the end of the world, no. Obviously if people look closer, they'll see there's more to a story (or picture) than just the car that was driven. He was obviously driving like a maniac in bad conditions, and some of that damage I would bet was the result of the jaws of life or another such device to get him out.

We just have to make sure that WE don't contribute to making our cars look bad.

Actually, a bad faith claim arises when the injured party demands that the insurance company tender the policy limit in a settlement, and the insurance company refuses. Any award against the insured which exceeds the policy amount is the basis of a "bad faith" claim.

The theory is that you pay for a certain amount of coverage, and the insurance company could have protected you by paying out in settlement the amount of the policy claimed by the injured party. Thus, if they decided not to settle within the policy limits, it was the insurance company's decision and it, not the insured, should pay the excess award.

Shake and Baked Snake.

I'm glad the victims of this perfectly avoidable occurrance of malicious ignorance and foolish behavior are Ok! Hence this was no accident..................But proof that for each action there is an equal and opposite reaction. It seems destiny has provided the Snake owner another opportunity at personal enlightenment, one that he will sadly over look taking advantage of with his arrogant attitude (post occurance description)........I'd be willing to bet a donut to a dollar that he will soon prove history will repeat itself given a self imposed opportunity.........

I would say nearly all (if not ALL) "accidents" are avoidable. If it wasn't intentional it was still an accident.

If the officer thought there was sufficent evidence to prove this was more than an accident, he would have likely arrested the Mustang driver.
