The car being "stolen" is what I'm hung up on. She was told that she could drive the car...she didn't go behind anybody's back and take it.

Many mistakes happened...
1. You let this friend take care of your car.
2. He let his sister (without permission from you) drive the car.
3. She "played" with it and didn't have the proper training to "play" with it.

In a perfect world...she can come up with the money to repay you. At 18, you know she can't.

Have her familiy come up with the funds ASAP (no payment plan, no "we'll work it off", or anything like that. One time payment. If they can't do that, you gotta do what you gotta do, report it as stolen and let her deal with the consequences.
Even if you had given your friend permission, which you didn't, that would not equate to giving the sister permission. Your friend didn't even give her permission. She just took it. It was a stolen car. No question. No excuses.

Man I hear you on that. I too was given a second chance if I joined the Military, so I did. I just got out in June after 8 years and 19 days active duty in the U.S. Navy. So I am also sympathetic to first time offenders, but I can honestly say my mistake didn't involve $35,000 and yours probably didn't either. I think you did the right thing by reporting the car stolen and she now has to face the consequences of her actions. Thank you for your service!

You need a new car
She needs a second chance or to make reparations.
Get a contract written up. Get it ALL in writing.
You local JAG will help and direct you as to who you need to talk to.
If she fails to make reparations, the contract you have is valid, even when you have to take it to the civil authorities, you initiated the contract through YOUR chain of command.
It becomes a legal binding contract in court if an agreement isnt fulfilled. This will be fair to you and to her for the mistake that she made. If she goes to jail, you dont get closure on it until her time is served- at the earliest.
Keep your emotions in check. But you have to document, document, document.
If she agrees to to the reparations, she make them to avoid jail. And her parents will eventually have to pay if she is on thier insurance. Its win win for you.

I agree with LadiesMan217. However, if they can't come up with the funds right then and there... which shouldn't be difficult (they could get a loan if they cared about their baby girl as much as they say they do)... then definitely proceed with the stolen vehicle approach. You can't just take someone elses car out for a joyride, mess it up, then say oops, sorry...... that doesn't fly one bit with me, whoever the person is. If my mother got in my car and totaled it, I'd feel the same way. You work very hard for your money doing a job and you rewarded yourself. Now some stupid 18 year old chick took that away from you!

I agree with the majority of posts on the thread. DONT let her "pay it off" over time. It will never happen. If she can't get a loan to cover that amount, let her parents get a loan. If they can't get a loan either, then report the car as stolen or driven without permission, or whatever it takes to get it repaired/replaced by the insurance company. This should show that you tried to work with them to keep her out of legal trouble, but if she can't meet your terms, you have no other choice.

No, I think you did the right thing. You don't want to spend the rest of your life trying to collect on a repayment contract...
