I hate to say it but you may have just shot yourself in the foot.

As long as you had the deposit on it, you had a good case. Now you took the depost back, they can say you willingly backed out of the deal. If they lied to you like they just did, what's to stop them from lieing to the court? They can easily just say you backed out, they called these other guys and told them the car was for sale, they bought it, you had second thoughts and came back and the car was sold and there's nothing they could do, so you got mad and concocted this story.

Would that make sense that I waited for seven months to get my car, checking regularly to monitor its progress, drive multiple times to finalize the deal, arrange payment from my credit union, and then sit down and say...wellll, guy's I really don't see a problem, but I don't want the car. Reminds me of a story. Gee officer, I was in this room with only this guy present. He was running around with sissors (and ya know his mom told him not to when he was a kid). And damn if she wasn't right. The poor fool fell on the sissors 57 times and killed himself. If the judgement is in favor of Putnam with the facts presented. I don't think my deposit left there would have mattered much. I mean they could also lie that I refused my money back, because I thought they should keep it for doing such a good job. Or better yet, that I knew the deposit was a non-refundable one (not the case).

Yes, I probably should have left my cash there. It would have been legally smarter, but I felt like I was eating a crap sandwhich. To get the BAD taste out of my mouth, and just get my money back and walk. I am encouraged by all the great members of this forum, and I will do what I can to help other people from getting hosed. I am still working on other things, but primarily...I still want a 2010 SS.

Unfortunately... I don't think it will be resolved for me. I have walked away from Putnam and would never do business with them again. Your friends may be treated well by them, especially if there comes a time when the cars are not in such high demand. A car sitting on the lot for a few months would probably sell for the agreed price. But if that were the case, I would finalize the deal as soon as possible, pay and drive away. If there is a time delay, given recent history, and the Market Adjusts again in favor of Putnams bottom like...well then it's time to worry.

I know what your saying, but there are things worth going to jail for...wouldn't give them the satisfaction of having them place me in the gray bar motel. I just wonder if they are getting the message that treating a customer in the fashion they treated me is HURTING their business. Sure they may have gotten more for my 1 car, but if they lost as little as 3 sales at MSRP...what did they really gain? That's what is hard for me to figure out.

That's pretty much how I feel, and the possibe course of action for me.

Anyway, I got to thinking about all this. I am certainly no expert in how the automotive indrustry works, but isn't GM a part of this problem? I mean, there is so much anticipation with this car, and GM is doling out a few here, a few there. With the smaller dealerships, they aren't getting that many to begin with, so when they do, I can almost understand why they are marking up. Consider the dealerships that are charging up to 15K over MSRP. Because there's so much anticipation over this car, there are those out there who have money that they'll pay through the nose to get one! As long as there are people like that around, this problem that Saving41 went through will only continue.

I really can't bring myself to blame GM. I tried to consider how they could have released the cars in a different way. Since they can't make 15K cars in a day, pay for all the materials to manufacteur them, hold them all until they were all 100% ready (QC checks and the fixes as needed),and ship them so that everyone would get theirs the same day. There would always be someone willing to pay more for getting the car earlier than everyone else. So I guess GM came up with their best plan, and went with it warts and all.


But again though, GM sending out one here, one there to the dealerships, especially to the smaller ones, it's no wonder dealers are doing whatever they can to make a buck. Is it unethical? Of course it is!!! But it's business, and ethics don't mean squat when businesses have an opportunity to make a quick buck. I've also been reading that dealerships might not see them again for months, which only adds to the problem.

Still though, Saving41, give 'em hell! You know you have all our support! Selling your car that you ordered back in October to someone else because you didn't want to pay more than the agreed on price is simply astounding!
