I rearended a escalade a couple years ago. She turned right on red right in front of me. I would have been screwed. She got out yelling at me and whatnot. But guess who was waiting at the light right behind her?? A cop saw the entire thing. I wish I took a picture of her face when she realized that. So its not always the rear car that is at fault. In this case I think it is if the OP had time to shift. Plus if there was traffic he didnt shoot out and she should have seen the car moving backwards unless she was on the phone. And most cars come with horns too. Unless she got seat heaters or something like that instead of signals and horns like most drivers around me.

I would have to say it is her fault because you were out of your parking spot already. However i must point out that your work parking lot is "private property" That is why the police didn't file a report. If your work has cameras in the parking lot, try to get a copy of the video.

Was parked along the street across from work on City property. Plus I was in the street when I got hit.

Still waiting for them to call me back. There was 3 other people in her car so she may be changing her story of what happened. Atleast there was 3 or 4 people outside smoking at work that saw it happen as well.
