I understand what you're saying here, but I'm not broke. Just hate losing the money on it that I put into it. I also didn't buy the car with the expectation of crashing it...and don't like living my life with the mentality of worrying about stuff like that. Takes away from the fun of life, but every now and then, this kind of thing happens and ya get bit. Thanks for your .02 though.

it was 0% loan, thats better than paying cash, you keep all the money and gain interests over time while they just get the same payment for 72months

I would agree its not a total, if they try to use aftermarket parts on it, try everything you can to avoid it.
Depending on the insurance company you have will be a big factor in how the repairs are made. What insurance co do you have?
I might be able to give you some deeper info on how to handle the claim with them to your benefit.

Sometimes they will call a car totaled, if they feel the repairs they can see, plus "unknowns" like electrical, alignments, vibrations, or more repairs that may come up once they get into it, are more expensive than what the car is worth.
If they don't declare it totaled, you should still be able to have anything corrected that they missed. Seen some on here that looked like a total for sure, but were repaired...Yours doesn't look near as bad...Good luck.

Damn I just made a call to my supplier and they do have all the parts available in aftermarket for our cars already. The hoods are even aluminum like the stock one is.
Let me know the insurance co and I can check thier guidlines tho and tell you what you can get away with.

If they do decide to fix it, I would go after the other driver for at the very least diminished value on the vehicle. This way you won't be so upside when you do decide to sell it and get something new.

I bounced my Jeep off a bridge here in MI on some black ice. My insurace company replaced all the parts with Jeep parts including the frame. Be firm and make sure it is what you want and how you want it done. They had to replace my windshield 3 times before I was happy with it.

I understand the point you're trying to make but I disagree. I modded my truck before I finished paying for it and when I get my Camaro it will be heavily modified in the first year. I still have 27 years on my house and I've made improvements/modifications to it. In this day and age it's unrealistic to think that people are going to wait to finish paying for things that they have i.e. a house or car or boat before making changes to them. At least that's my belief.

not exactly. its more often than not either 0% or discounts. not both. judging by him still owing $40k I'm guessing that was his situation. getting, say, a $38k loan at 2% for 6yrs beats a $42k loan at 0% for 6yrs anytime of the week and twice on Sunday. sure the difference can be made up with the gains you can get by putting the cash in a savings account and even them out to be about the same. but then you wouldn't be so much upside-down on the loan if you had taken the discounts instead of the 0% in the unfortunate event that something like this happens. just saying. 0% is, more times than not, anything but free money. these days not many people are in the business of giving away free money. no to make the OP feel worse and I'm certainly not judging him. just hoping it was a lesson learned. even if it was given the hard way.

I understand and agree on a home. and who doesn't want to make a car their own? I'm just saying on something such as a vehicle if you're not going to spring the couple extra bucks for the gap insurance then getting out of water first is usually a good idea. specially if you have a few extra grand laying around.
