dont feel bad for the salesman. The sales dont go through anyways unless approved by the sales manager. Even then, it has the get past the evil watchful eye of the finance manager (the paperwork guy that makes u sign 100 different things) after that before everythings said and done.

if you feel like making a compromise ( i wouldnt) tell youll pay $1300 more if they give you $1300 more for the trade.....i wouldnt even do anything for those assholes though, they probably already sold your car and made money on it anyways so if they wanted to undo everything it wouldnt be possible.

The dealer has handled this terribly.

Absolutely. And lost a good customer too boot.

They should have followed this rule of thumb: if you have a good experience, you may tell 3 to 5 people to go there and buy something. If you have a bad experience, you will tell 30 or 50 people to NEVER go there.

The owner of the dealership spoke to me today and said he would not pay off my trade in until I come into the dealership and settle the difference. GEEZ! Can he really do that?

Yes, he can! Just like you thought it was a final deal when you signed the papers, it is not final until he pays off your trade-in and puts it in his name. You have left a door open for the dealer to pressure you. Call your local TV station and see if they may want to report about these "happenings". Dealers hate bad PR! Keep us posted.

I think our relationship with this dealership just ended.

Call Chrysler back immediately!!!!

OR

Tell the owner you want to cancel the whole deal as they misrepresented the price.
You want your trade back and they take the new car back.
They will say you put miles on the new car.....Tell them it was their mistake not yours.
They take the new car back and make you whole, or wave the $1300.
Again....you have done nothing wrong.

You have already made one payment? That means you've had the new car for 4-6 weeks??
Why did it take so long for them to contact you about THEIR mistake?

Yes he can refuse to pay. However, he has also signed the contract stating he will pay off the trade in. If he fails to do so he is in breach of the contract and is liable in court. Not only will he have to pay off the trade in, court cost but punitive damages... ie credit repair, lost wages etc. Since both you and his business enter into an agreement and signed a contract, he is a responsible as you. No you are not responsible for their mistake. The only thing they can do is ask if you'd be will to make up for their mistake. They can't and have no legal right to make you pay. I would tell him if he fails to honor your contract you will see him in court and that not only he will not get the $1300 which was a mistake on his side, he will be paying court costs and punitive damages, loss of a loyal customer, and the publicity of being a dishonest dealership.

Good luck.

Please update as you progress on this. I love to hear about dishonest salespeople getting their comeuppance. In a world with no superheroes, seeing justice is the closest parallel.

On a side note: why aren't there any real-life "superheroes" who normal people can hire to whack really bad criminals like murders, rapists and child pornographers? We all love superhero movies, so it just puzzles me that there isn't one in real-life.

My lawyer has said you can pay $2500 for a lawyer to defend and be right or pay the dealer $1000 and put it behind you.

They would have to pry that money from my cold dead hands. I don't care how hard it would be there is no way I would pay it. Call the bank, and let them know the dealer is threatening you, call Chrysler, call the mayor. But if that piece of crap dealer calls you again, I would calmly explain to him that even if it meant living a long happy life, or dying a slow painful death, he will never see another penny from you.

Why is it that when they make a mistake they want you to do the "right" thing for them, but if you found a better deal a single minute after you sign the paper work its tough luck Charlie?

give them the car back and take your business elsewhere. You should not have to pay for their mistakes.
