Just kind of wondering (OK, ranting) about HOW could I be entirely at fault, when it was his inattention to what was right in front of him and his actions that forced me to react and swerve. After all, he was crossing 4 lanes of traffic, just to get to the lane he wanted and obviously never saw me already there. How is that my responsibility?
I would definitely go over that police report with a fine tooth comb. It makes no sense being your fault. Glad no one was hurt but with PSTD, I would imagine it would take some time to calm down. Wish you luck and make sure you "go over" that police report.

I've heard (from more than one source), that insurance companies are disregarding the 'findings' of the officer on-scene and doing full investigations on their own to decide fault - for exactly situations like this one, where fault is assigned arbitrarily based on "witness" accounts (being a cop for so long, I KNOW how unreliable witnesses are), partial information and a host of other reasons that are not relevant to the incident.
