I guess the point is it's just not worth all the time and trouble. The dealer is an a$$, your not going to get the car. He can just jerk you around, and there really is not much you can do about it. I would be really shocked if you would win that case and get the dealer to pay YOU $5,000.00. There is no real way to hold them to their agreement if they are not willing to be honorable.

Chances are the dealer will be able to pull out some signature or some policy that will protect them. I would just dump the order and go somewhere else.
To most people, it'd be worth it to take a really good shot at a claim for $5k.

Hell, I'd have fun with it. You get to play lawyer for a day. As I mentioned, here in California you get to subpoena people and documents. Here's the form:

http://www.courtinfo.ca.gov/selfhelp...s.htm#subpoena

Subpoena the salesman, and all documents showing the price the car was actually sold for. Let the salesman try to explain this all to the judge.

I don't understand.People are saying they will never buy GM again because they didnt get signed agreement with the dealer.Thats like saying you are never going to buy a sony tv because Sears is too expensive. But then they make a statement of possibly buying a challenger instead?? Wake up ,challengers sold for $10,000-$20,000 over MSRP less than a year ago.

It doesnt really matter what you think this peice of paper does or doesnt do, the fact is the guy got screwed. But legally nothing he can do. Even if you are able to legally do something, your going to really be that homo that sued to be able to buy something, come on.
Are you serious?

Nothing trivial about breaking a contract IMO. I would go small claims route initially, really easy and no lawyers involved.

Seriously, people come on here screaming bloody murder when a dealer pulls this crap. Everybody on the forum joins in, saying how outrageous it is.

Then someone suggests that they take a day to file a small claims suit, and all of a sudden it's "trivial", and you're a "homo" if you bother to enforce your rights.

Taking 1 day off work to get back about a month's pay from a crooked dealer seems like a pretty good idea to me.

I had a Town seize money from me to satisfy a renters water bill. The amount was only $100.00 but it was the principle that really mattered. I sued them in small claims court and won easily.

It was worth the effort to sue just to listen to the Judge reprimand the Town councilman and they had to pay interest on the money plus court cost.

The moral of the story is "Don't be a *****!"

I take back my "trivial" comment and apologize. I appreciate the fact that you've come here offering possible solutions. It's great to have a lawyer here who can educate us all. I've been involved in a few business lawsuits and I was just comparing this to my experience. Again, I thank you for your advice.

I couldn't agree more.

And I also appreciate you taking your time to educate us here. Very valuable information that you are giving us for free.

Thank you Sir.

i would find it easier just to go buy somewhere, else, in the end they lose your business. Why would you want to buy from a crook. And you can bet from there on out that they will know your name at the service counter.

I think it's interesting that Tom Benson would be involved in this kind of thing. I'm purchasing mine from Freedom Chevy, and I don't really have anything signed per se. I know they're going to try to charge me an extra $1000 for random stuff like window tinting, Wash Tub car washes for who knows how many years, and other random stuff, but they're not marking up the price 4-5k. If it helps any, you can let your dealer know that other dealers in town, in fact, are not adding any "market adjustment" mark-up to the Camaros at all.

Be sure to let us know how things go down.

Email your story to joepags@woai.com.

He called out Ancira already over Camaro gouging. If you call them they would probably put you on the radio if you want tonight between 5 and 8. 210-737-1200

No problem, and I understand some people will probably decide it's not worth the trouble.
