Dealer Called. Needs Money.

I bought my Camaro a couple of months ago. I added some money to my initial down payment at the time of pick up.

The dealer called me a couple of days ago and stated that the extra down payment was never received. However, the additional down payment does show up on my paperwork and is signed. Done deal.

I checked my account and indeed the money was not taken out for the extra down payment.

I don't have a problem with paying the extra down payment a couple of months later buuut....

I figured I would throw this out into the Camaro5 community to see if I am missing anything and to get comments.

If you owe it, pay them. Look at it this way. If you saw they accidentally took the payment out twice, would you say anything, or just let it go?

ok you have proof of payment in your statment take that down to them and show them and you dont have to pay agin..

Yeah they lost the check. It's hard to believe a dealer actually lost money though haha! You owe the money, so I would go in right away and pay it. But... Make them pay the stop payment fee on the check they lost.

Odds are its attached to some paperwork in the loan office and they will find it. You don't want them cashing that check after you go in and pay the money a second time.

In the legal world it's called unjust enrichment. And since you know that they never received the money you are no longer an innocent recipient. (even if you were an innocent recipient you would have to give the money back unless as a result you had a change in circumstances, but i don't even think that would work given the facts) You will get sued if you keep the money. You will lose.

I would say pay it if you owe it. It will more than likely cost you down the road. If the dealer treated you right and you might want to do business with them again take care of it.

Pay it, but make them pay the stop payment, show them proof of where you wrote the check if you have it, (carbon copy). That would be the right thing on your part and the fair thing for them to do since they lost it.
