My personal thoughts, I'd tell the dealership "look you damaged my property and then one of your employees tried to conceal the damage. I'd like for you to get me a 2023, optioned out identical to mine, you're going to give me the best market value you can for my trade-in, and you're going to only charge me MSRP for the 2023, otherwise this is an attempt to defraud me, and I have no problem contacting a lawyer and the state district attorney on this." Oh and personally, I'd see if they can give you GM supplier or better. The reason I would want this is because sure they may fix it, but it'll always be gnawing at you that they tore up your splitter. Oh and I'd make copies of what you have, and you may even threaten to post the images up on social media. I know it sounds harsh, but this is IF they refuse to do right by you. Sadly, I've been in way too many situations like this where the responsible party doesn't want to do right by me and my first reaction is to press them, and press them hard. Good luck, and as I stated I'd ask for something more than just the fix because if it shows up on Carfax, that's going to cost you quite a bit in resale.
You also call the State Licensing Board, to revoke their merchant license or repair license whichever is applicable, if they do not comply with your terms.

Revoking their licensing will shut them down as a business.

I wanted to give everyone a quick update. I just sold my '18 ZL back to the dealership today and placed an order for a '23 ZL1. The details are below.
  1. $60K buyback
  2. Factory Wheels/Tires from my Current ZL1 - Replaces damaged aftermarket
  3. Winter Tire Purchase in the Fall - 50% Discount
  4. '23 ZL1 Order placed with GM Family First (Employee Pricing)
  5. VIN: 1G1FK1R6XJ0174654

The dealership owner would not allow me to purchase a Z06 as he is pricing these with Market Adjustments of $10k and up. I am not willing to pay $10k to $15K over MSRP. I am basically getting into a '23 Riverside Blue ZL1 for around $3k above the buyout price which is good result from my view. I posted the VIN for anyone in the St. Louis area seeing a used '18 Red Hot on the market in a few weeks.

I appreciate everyones feedback and views since my last posting.

Thanks,

Richard

Nice. I hope you are made whole. The infraction here, IMO is the tech trying to patch it up himself without reporting the incident. Imagine if you didn't have the dashcam recording, if you just started driving and noticed that the part had become loose again and began violently shaking at high speeds. It could've either been a driving hazard or after you tried to return it to the dealership, they could've pinned the damage on you. Some people will claim that it wouldn't have come to that, but it's like shooting someone in cold blood, and not being charged with anything because the person didn't die, or because you missed. Intent to defraud was the crime here, and I think the dealership understands the severity of what their tech did.

Sounds like you are making out good on the deal. Is that tech still employed there?

I think I would be pleased with this outcome if I was in the same situation and the dealer probably would have earned my future business. It really seems like they stepped-up and took care of the situation quickly without giving you the run around which is not what I'd expect from a dealer at the onset.

Hopefully you're happy with the outcome, which is what matters in the end.

I know he was going to get written up but they didn't specifically say they were firing the employee. The service staff are all unionized in the St. Louis region so it would depend upon the union agreements in place.
