While the dealership should take responsibility for the sake of customer relations, just because one of their employees does something wrong doesn't automatically make the dealership responsible. While all states can vary, most businesses are not liable for the intentional torts of their employees (certain exceptions apply) but they can be responsible for negligence on the part of an employee. Nevertheless, the best advice you got in this thread was talk to an attorney.

Seeing that the dealership admitted the car was stolen by an employee that is what happened.

go read the thread over at the link...the dealership LOST BIG on this one. The wreck happened during business hours. A joyride ensued after a routine oil change (no drive required) Employee put the car in pretty much full race mode and promptly found a stationary object - ie CURB! and ripped the underside of the car pretty much off. Dealer tried to screw the M5's owner. Many M5 owners deluged the dealer through social media and they lost face. Further, the courts destroyed the dealership. Outcome was good for the owner but it took time and money. The dealer SHOULD have paid up front with a replacement car but decided to lie, cheat, and fail - and they lost a lot more money than the replacement car would have set them back. Here's the link: http://www.m5board.com/vbulletin/e60...16-months.html

The OP hasn't posted an update to his dilemma, I think with should refrain from making any assumptions till he let's us know what's going on with his situation. I truly feel bad for him and I hope that it gets all resolved soon.
