Dealer Messed up BIG

Hey,
i've been lurking this forum for about 3 months now and never posted. I've bought a new 2011 yellow SS converitble in Feb 2012. I've had numerous issues from day one such as: water leak, transmission (six speed), heating, convertible top wrinkles and rub marks. I got a letter in the mail from GM about the top fix and took the vehicle this past week to Champions chevrolet on gulf freeway houston, tx. This is where everything went downhill. I dropped the car off Monday and they sent it to trim shop to replace the top due to hole forming. Between the dealer and trim shop one of them wrecked my car. Now the dealer is trying to put me in a new vehicle by taking my old camaro as a trade in value. GM is giving them $4500 as a trade in allowance towards a new car. Now i don't want to buy another vehicle from them. I want the dealer to pay off my loan on my camaro which is $46,000 but the dealer wont pay for it. What can i do? Any lawyers on this forum want to help me on this. I didn't want to trade in my vehicle. I feel like im getting screwed on this one.

If u get a brand new car and ur loan doesn't change and u don't have to pay, I say take it

if it is totaled their garage owners insurance policy should cover the damage to your car. Now naturally it is only going to cover the actual cash value of the vehicle. So hopefully you bought gap insurance when you did the deal. good luck op this really sucks to hear.

wrecked in scraped the passanger side and driver side where they would have to repaint and take out dents on both sides. Which ultimatedly will lower the value of my car. If i get another chevrolet from them they will pay off the old loan and start a fresh loan, but i think they will put some negative on the new loan to work the numbers. My question is why should i be stiffed with the negative? i didnt want to trade in my vehicle. i have 0% 72months on the current loan. the 2012 camaro is not 0% for 72months.

i didnt cause the damage to the vehicle. my car only i had 4,000 miles and had it for 3 months.

Being the assistant sales manager of a Chevy Dealer, I'll give you this advice. Call GM, tell them you want a new car, you want it from a different dealer due to bad experiences you've had and you want the loan in full to be paid off and not written into the new loan. Keep going up the chain if you have to.

Also, another good option is to talk to the owner of the dealership.

Walk out with or without your car? GM didn't screw up your car, the dealer did. Maybe you should involve them with trying to make it right?

i did call GM and they said the dealer is willing to give you a new car but i know the dealer is gonna work the numbers where they dont lose money. I asked for a new tahoe which they let me test drive for the weekend. Hes selling me a $57k tahoe for $49k. Which is a great deal but i decided not to get it. He said come monday and we will talk about what car i want. I told them what happens if i dont want a chevy from you. He said it doesnt work that way.

im not walking out with my wrecked camaro. why should i suffer for their mistake. they screwd up and they should eat the cost.
