I am suggesting it is his money and he can do what he wants with it including not wait for something any longer than he was told. And it is not a lie as he can not afford it any longer if he purchases the other car.

Bottom line, asking a bunch of guys on a forum what to do is a waste of time for the OP if he has not even approached the dealership first.

If you read my posts on this , I suggested he talk to the sales manager ,I never said he should tell them he is going to buy another car from another dealer . Simple , just took too long .

Just ask the dealer. If they are good people and ever want your business in the future, they will give the deposit back. Most would do that in good faith and your future business.

Ok talked with my dealer and there were some problems with the order , they said 1LE was on constraint? So they actually dont know when car can be ordered! Or if I might have to wait on a 2015. My salesman was suppose to have called and told me all this two weeks ago , says the general manager. So now we are looking into finding one on lot somewhere or getting my deposit back. Thanks

Just tell them some personal things came up and you cannot commit to the purchase and hope once things are ironed out you would like to come back to them.

Did you read my post? I didnt state that you said anything, someone else did and you implied that it would be wrong to lie to the dealer, and if he doesn't lie to the dealer, the truth would be "I'm buying it somewhere else". That would, at a lot of dealerships, prompt them to start the usual BS to get the customer to buy their car.

I had to special order mine twice, first time was done with wrong option package. Didn't require a deposit for either. Who requires a deposit for a car order?

Almost all states have laws that say the deposit is refundable. Make sure it's a deposit, and not a partial payment on the car. That's a distinction in some states, like Okla, but not is KS. Also, since the car's not going to be there in the time frame quoted to you, they haven't fulfilled their part of the deal, so in my opinion, you can cancel. Very unlikely that they'll sue because they don't want the negative internet slamming that would come with it. The salesman may make some threats, but very unlikely it'd be anything other than scare tactics. And, yes, I am an attorney.

As I said ,talk to the SALES MANAGER . Sounds like you got the truth by just asking the right person at the dealership . In the end it will work out ,and you will get what you want . Some times thing are just that simple. I hope we will both be driving a new 1LE ,be it a 2014 or a 2015.

I have ordered 3 vehicles, all had refundable deposits. For them to keep your money especially if you didn't sign anything is criminal

When I ordered my 2010 Camaro the first time in December 2008 I put down a $500 deposit, on the paperwork it said Non-Refundable. Just before my car was to be built in April 2009 I was "Early Retired" from my job, that day I went to the dealership to cancel my order fully expecting to lose my deposit. Instead he cut me a check to refund my deposit immediately. Needless to say when my financial situation became stable again I went back and reordered from them.
