A lawyer isn't needed. Hopefully you called the police to get a incident report and already called there insurance. Once an agent contacts you mention the unconvienence fee first. They will pay between $200-500 for each passenger assuming you had any. The deappreciation value claim is after they fix your damages. Your car now will deappreciate because its been in an accident.

2 facts here.

Fact 1. If he was a good driver he would of noticed the car going a little to fast. Therefore see you brake for that driver. He (BMW driver) is a moron.

Fact 2. That color on the BMW is hideous.

OP hope it works out

some places wont do an accident report if the damages are not excessive, but i think you can still go in and file your own accident report. best check it out.

did they give the other driver a citation?

Hmm. Not sure why they didn't make one, I always ask. Makes the claim smooth and makes sure the right person is at fault.

Hope everything works out though.

at 911 they asked 3 questions
1) is there any damage to public property - no
2) is anyone of you are under influence - i guess no
3) is anyone of you injured - well not really
"then just exchange insurance information"

Plus, go to the doctor! My aunt was hit in a minor rear end job years ago and had neck pain the rest of her life.
