Rear Ended, Adjuster came, what's next?

I was in a minor accident yesterday, I was rear ended by a Lexus rx330. She hit me hard enough to leave an imprint of her license plate number in my bumper. I was in stopped traffic, she wasn’t paying attention, and accepted full responsibility.

The insurance adjuster just left and offered me a check for $800 for the damage. He is saying the damaged fascia can be repaired and painted to look good enough. I am wondering if I should push to have the bumper cover replaced. The part itself is $400+ from the dealership (I know I can find it cheaper but just as a reference) plus the paint, labor etc.

1- Am I within my rights as the person who was hit to push for a replacement over repair?

2- Has anyone been in this situation yet?

I would get SEVERAL Estimates to repair the Damage and use that to negotiate... You have the right to have your vehicle repaired at whichever place YOU CHOOSE.. After you get your estimates, submit the estimate to their insurance company for payment.. Do not Accept their settlement until you have several estimates.

I took the car to a body shop right after the accident. I work across the street from a few, and I was told 700+ to repair but I should fight for a replacement. The adjuster told me today "It can be repaired, Progressive wont pay for a new bumper. If you want to go through your own insurance, you can, but your rates will go up and there is a chance they still wont pay."

Umm...what is a "Good Enough" repair when it comes to his client hitting your car and causing damage? Would he settle for "good enough" if you hit his car and told him you would give him "X" to fix HIS car "good enough"? Ugh.

That was my sentiment exactly. He tried to backtrack and say that he would have it repaired because "nothing lines up like the original panel..." and all that. As if every singel rear bumper is different. I didnt argue with him but I did say I would not be accepting a check today. Im in no rush, I want it fixed correctly.

I had my bumper repaired a few months back. My dealership repaired the damage and repainted the entire bumper. I think it looks better than when I bought the car. The paint matches better. There isn't anything wrong with repair work as long as it is a quality repair...

I have seen his work...I can attest. I just did not like the adjuster's use of "good enough"

You need to contact your insurance company!! Do NOT accept any settlement check either. Your insurance company will fight the fight for you, that's what they are there for. Get YOUR estimates from YOUR body shop you want doing the work. Your rates won't budge! The adjuster offering to you to go through your insurance for a claim would most likely affect your rate, but that's not what you're doing here.

Word... and whatever you do, do not accept any check until you are satisfied. The reason they offered you the $800 was to keep their loss down, and if you had accepted it that would be the end of it and you'd have no further recourse. Let your insurance fight this for you.

Get your repair estimates from a Chevy dealership...they are always the highest. I wouldn't accept a repaired facia...get a new one!

You shouldn't be dealing with their insurance company at all. Get your estimates, submit them to your insurance. They will then get the money from the other insurance company. If the other company argues, YOUR insurance company will pay for the repairs (at no cost to you) and then will have their sizable legal team retrieve the money from the other insurance company.

Whatever you do, DO NOT ACCEPT anything they offer you. Doing so forfeits your right to anything else.

Problem is, their insurance company IS my insurance company. We both have progressive and theyre telling me to just drop it off at the bodyshop and any extras will be paid if they find any more damage. I hate this stuff.
