Not sure about the rules in FL, but here in PA an insurance company can NOT require you to use aftermarket or used parts for your repair. Their initial estimate may very well include aftermarket or used parts to keep costs as low as possible, but you can demand new OEM parts, and they must comply unless new OEM parts are no longer available. I went thru this 2 years ago with my wifes GTI. Insurance estimate included a mix of new OEM, aftermarket and used parts. My body shop and I nixed that immediately and sent them a revised estimate to only include new OEM parts. They complied.

I'd look into your local laws to see if that's the case in FL.

I've heard this noise before. I'm 99% sure it's regulated state by state, Florida Department of Insurance in your case, with the various representatives involved in repair all taking credit for it like they are doing you some sort a favor, despite it being required by law.

Evidently, in Florida quality non-OEM parts are acceptable (and legal). I went to Google and found this:
(4) An insurer may not require the use of replacement parts in
the repair of a motor vehicle which are not at least equivalent
in kind and quality to the damaged parts prior to the loss in
terms of fit, appearance, and performance.

So I guess "if it walks like a duck and quacks like a duck, then it is a duck" is how they pick replacement parts. I'm still going to push for OEM. The worst they can do is say no.

BTW, I looked through my policy, and it doesn't say anything about OEM parts, either way.

We've all heard of Murphy's Law. Anyone know where I can find a good Murphy's Lawyer?

Yes, non-OEM parts are acceptable in every state if they are equivalent in quality.

You need to find out if YOU have the right to refuse them. Here in PA, we do.

Simply start by telling your insurance company/shop that you will only accept new OEM parts. If they agree, make sure you get it in writing and confirm the parts ordered are OEM.

I just had this happen to my 2016 impala. I'm waiting on the dealer to call me when my oem parts are in. I pushed for new Chevy parts and my insurance had no problem with the dealers estimate and the use of GM parts. I think they said because it was less than a year old(4 months) that they will use new GM not aftermarket. Hope you get your rare GF back looking like new. I like my impala but I'm so glad it wasn't my Camaro. Good luck!

It is regulated by The [State] Department of Insurance. In Texas, if the vehicle is less than two years old the repair shop must use OEM parts.

Beyond that, we can certainly "request" the shop source OEM, but more often times than not....they will not.

Thanks for your concern. I actually did post a follow-up once everything was said and done, but I put it in a different thread. You can see it here:

It's not perfect, but it's close enough that it's not worth spending the time to keep going there to drop it off and pick it back up. Overall, a terrible experience. It was originally only going to take about a week and a half and wound up being a month. Also, after paying a $500.00 deductible, my insurance went up by 10%. My insurance paid for the rental car, but I paid for the rental company's insurance (since I originally thought it was only going to take about a week and a half). Add the depreciation in value when I eventually sell/trade it in, and I'm out a few thousand bucks, easy. But I put it in perspective: at least I have a kick-ass Camaro to be upset about and I'm not stuck driving some decades-old beater as my only car like I have in the past.

Just one more reason to say 2016 sucked!
