You wanna get out of it on a technicality? If you really want to be Perry Mason and win I'll tell you a way that has a better chance of success than where you are going with it.

It is your right to review all evidence that will be used against you for a reasonable time before trial so you can prepare your defense.

Here's how you do it, the legal way that is within your rights. File a motion of discovery, subpoena the officer's notes and request a certificate of calibration for the patrol car speedometer, since pacing with his car is his key piece of evidence against you. Request a certificate that demonstrates the officer has been properly certified in pacing vehicles.

This will drag things out, you may even have to appear in court several times but it's highly unlikely they will produce these items for you, which is grounds for a dismissal. As far as you are concerned, you will never be prepared for trial until you have some paperwork in your hands. The judge always asks "are you prepared for trial today?"

Sounds a little out of your league, sounds like a lot of work? Welcome to being on the wrong side of the American justice system.

They've seen all those moves before. Everyone trying to get out of a ticket has tried every angle before. Your epiphany based on your supreme intelligence has been done thousands of times.
Police car speedometers are calibrated prior to purchase by the manufacturer and do not have to be re-calibrated. The old "request a ton of info" thing usually doesn't work. The easiest way out is to contact the court clerk and as for a pre-trial plea deal- pay the fine and walk with no points and no judge involved.
Almost every police car in this country has a video system... sometimes the obvious is overlooked.

Like I said, you have the right to view all evidence they will use against you prior to your trial. It's a motion of discovery. If they plan on using dash cam footage you are entitled to a copy before your trial so you can work on how you will refute it. Otherwise you would be put on the spot, which goes against your constitutional right to a fair trial.

A trial is a trial and a courtroom is a courtroom, they don't ignore your rights just because it's a petty traffic offense. The thing about rights is that if you decide not to use them no one really cares or complains and it's your loss.

You have a right to have a jury trial for a traffic offense, you can also appeal to a higher court if found guilty.

Now that we have covered rights I'll tell ya that I agree with what you said, just call the clerk and find out if there's a diversion program...cheaper and easier no jail on the line anyway. Diversion programs usually keep insurance hikes outta the loop too.

What if it was a street racing ticket, and forfeiture of your vehicle was at stake? Then we might be exercising our rights a little more eh?

Why don't you go sit in traffic court for a few days and see how many different excuses people come up with to get out of speeding ticket. Maybe you will be able to come up with an idea that no one ever heard before and the judge will let you off for being totally unique.

You admitted that you were guilty of the non-moving violations, dark tint etc. Most police officers are very good at judging speed because it is part of their training to be radar / laser certified. Grow a pair and seek out an attorney to help you or pay the fine and slow down before it becomes a much more serious incident. But stop your whining !!!

that depends on what state you live in as most classify traffic offense as civil instead of criminal and don't allow jury trials for civil offense. and even if you could, be prepared if you loose cause requesting a jury trial for something like a speeding ticket is going to piss off everyone and they're going to hit you as hard as they can if you loose.

For a traffic offense they are going to give you the maximum anyways unless you get a judge in a good mood and you're able to plea it down a little. It's not like if you pissed them off they can put you in prison for life...

For the OP , take your chances with the judge , and hope he is a FORD/Dodge guy , then he will be simpatetic with you , just becUse he will be happy that you ( A Camaro ) guy came to his court and proved that his car is faster than yours
