Advise needed for tire rub

Need to find out what the long term affect of this tire rub. The mark is at base of tire tread and appears to occasionally run top of fender. I can not feel any issue while driving.
This is a brand new wheel/tire setup (315/35/20 and 275/40/20 front). My car is lowered with B&G springs with 1.2 drop at front. There was a miscommunication on aspect of front tire, I thought it was going to be a 30 series. The receipt did state 275/40 and I failed to see that. I understand that we are only talking about a few millimeters difference in height between 40 and 30 series. From the picture, it looks like all I would need is a few millimeters to avoid the rub.
Is this simply a nuisance that might lead to premature tire wear, is there danger of fender damage and/or significant tire issues?

If there is a significant cause for concern either with tire or fender damage, then I need to ditch these tires soon and replace with 30 series.
If this is nuisance that will not cause much issue, then I will replace with 30 series at next tire purchase.

It's not really a small difference between 275/40 and 275/30. 275/30 comes out to 82.5mm tall and 275/40 comes out at 110. Remember the second number is a percentage of the first number, not an actual number. You are talking about a whole inch difference.

If that setup is supposed to be run with 275/30, I would make the switch now, before you damage the fender off a pothole or something rough.

As you sit now your front and rears are the same diameter. If you go with 30s on the front your ABS and StabilTrac may not function properly.
IIRC, 0.5" is the maximum difference in radius allowed.

What about 275/35/20? I talked to tire store and there is 1/2 inch (shorter) difference between my tires at 275/40 and 275/35. That sounds like it would work for rub issue and max diff in radius

I spoke with wheel/tire vendor and they think I actually have positive camber, top of tire is pushed too far out. Issue could be resolved with alignment and some negative camber

Only an alignment rack can tell you if your camber is out. Do that quick to prove or disprove the tire salesman's claim. The minute changes in alignment will not change much I bet. Your tire guy is trying to get out of replacing all your tires, that is their job.

Thanks for the advise guys - I will be taking it in today/tomorrow for front end alignment. I hate that I have to do this, because I have boxes of suspension goodies. Unfortunately it will be a few more weeks before I get to start that. Hopefully a quick front end alignment will answer this question and end this rubbing

I really don't think the alignment will end that much rub. Hopefully the place you take it has some knowledgable people that can help you out.

Here is what the alignment found:

Right Front Camber: -.6
Left Front: Camber: -.8

Both are now at factory spec at -1.5
The is a significant visual difference but I did road test as well. I scrubbed the existing rub marks as best I could and applied some tire shine. Went for a spirited drive down some hilly country roads, good suspension exercise. There were no new rub spots.

ABS is happy when the front is 5% smaller than the rear.

I would change themm out to the 30 profile before the fender gets damaged with the wheels turned as you travel over a bump.

If you can tuck them a bit further with negative camber, you should be safe.

You should roll your front fender lips--NOW. But have a pro do it (don't ask me how I know). The real problem you have is your wheel offset--it's too much by at least 1/4". I have MPSS in 295 on my front and had rubbing. I couldn't get 285's which might have solved my problem. Not rolling my lips sliced up my fjrst set of tires after less than 1,000 miles. Over a grand to replace the first two.
