Trading a car in while it's tuned

Say you trade your car in and it is tuned. It's then sold and the new owner needs warranty work done. Can you be held responsible for the lack of warranty, especially if you do not disclose that it has been tuned/flashed?

No you won't; unless otherwise specified, when a vehicle is sold by a private party, it is understood to be sold 'as is' without any type of warranty/guarantee.

We don't check used cars for tunes. Haven't worked at a shop that has. I will check if something is broken and I suspect tampering though.

While you may not be liable, you should certainly disclose the tune if you're selling it to a private party. To do otherwise would be shitty. Trading it into a dealer,....well I would probably let them know. They can always reflash the stock tune back on if the car will run fine with stock tune.

The only time I've known for someone to be held liable is if the dealer specifically asks to your knowledge if the car has been tuned and you lie to them and say no.

But as said above, it's not something that is normally checked for or asked about.

If it was a handheld tuner it may be wise to return to stock so the tuner is unmarried to the car and can be used on another one? just a thought. If a dyno then of course it wouldn't matter.

Well, I don't know about the liability issue, but I do know that if I were buying a car and having some warranty left was a big reason for choosing that car, I'd be really upset if I needed it and didn't have it.

I get that you are trying to get the most out of your car on trade. While a lot of folks don't hold high esteem for dealerships in this regard, somewhere, there is someone just like you or me that could get royally shafted from something like this.

Simple solution.....disclose the info. All my recent cars have been tuned. Always let the dealer know. Only hurts me a few hundred or so....because my cars a we'll maintained and not ragged on.

When I traded my Jeep SRT8 in I disclosed everything and provided all receipts and paperwork. Actually helped me and I got SOME value back on trade in. Just my experience.
