Mine smells most on cold start, less so on warm start, and just a little after stopping for gas or something when it's only off for 3 or 4 minutes. I only notice it when I start it in the garage or start it outdoors and back up through the exhaust with the top down, and it is never noticeable when it is warmed up. It sounds like yours may be running richer.

I don't know much about the laws in CA, but I've been told here in AZ that they look to make sure you have cats on the car in addition to checking for codes.
