I opened a small shop this summer and was trying to free up cash for equipment. I really hated the idea of selling it in the first place, as it is one of only two fifth gens I've built. It's a lot easier to show people the quality of work you do rather than just tell them. I have a small local following in the classic Mopar segment, but had not done much with the fifth gen's until I purchased one! I find doing this type of work to be much more enjoyable than my day job of repairing Mercedes-Benz vehicles!

While I agree legally you have every right to that money, I would have a hard time keeping it. Depending on the amount especially. I would keep what I see fit for the hassle of not being able to drive it for the time you garaged it and return the rest. You never know, people suddenly hit hard times and no longer have the financial means to follow through with the contract. To each their own.

Yes, we were in constant contact. He bought 7 or 8 muscle cars this year, and decided for whatever reason he was spending too much. He bout atleast 3 of those after giving me the down payment. The last being a 71 challenger from my neighbor for$60k. I think his business just slowed more than anticipated this fall and he got in a jam because of all the cars. He said he doesn't expect a refund, but to do what I want.

Ah that sheds some light on the situation. I wouldn't feel guilty after hearing that.

Mixed feelings on returning part of the money. I think it's extremely generous that you're even considering it - but if he just spend $70k on a different car then I would guess he can afford it. Sounds like he knew what he was doing and decided to spend his money on something else.

IMO you can't go wrong with either decision you make.

A deal is a deal, from what I've read he is a grown man, he knew what he was signing up for.
Don't you think that the time you lost for not driving (and storing) the car, is so much more worth than what he paid you as a deposit?

The car was supposed to be paid for in July. I figure I did more than most would have already by storing it this long. If he shows up with the money in the near future, I'll probably let him have the car. I like to treat people how I would want to be treated.

Honestly, I'm glad it worked out this way...I really didn't want to sell in the first place. I'll return what I can of the deposit (most was spent on equipment already) in the spring, but it won't be anywhere near what he gave me. I just think its the right thing to do. If I still had his deposit in full, I would return all of it.....but he knew why I was selling and that the money was being used immediately. I've spent damn near all of that deposit already, but as I start making money I'll put some aside for him.
