handicapped parking spaces are not enforceable without blue sign per ADA-regulations?

I just heard that this was the case. I have been looking into state and federal law and this appears to be the case although I can't find the actual law its self to confirm this for certain.

Does anyone have any insight on this?




Also, I understand that people should generally not park in handicapped parking spaces regardless but in situations where the entire lot is empty including 10 handicapped parking spaces right in front and you are just running in for a second, this is something that is good to know.

Unless you are handicapped, or have someone handicapped with you in your car, and one of you has a parking permit to hang from the rear view mirror, here in FL they will NAIL your car for being in a handicapped spot.

Be happy you are healthy enough to walk from the back of the lot...and park back there. Nothing is THAT much of an emergency, except runs to the emergency room itself...and we can always be happy at the extra exercise we get thereby.

Don't do it no matter how many empty spaces there are. If you are not handicapped don't park there.

It's true, legally you can't be ticketed if there is not a blue sign present. That being said, I would not park in a spot that I know is intended to be a handicap spot.

OP you may be right as per the letter of the law, here in CT they must also display the monetary fine amount, but rarely do they since the laws change in regards to signage, and property owners usually are not made aware of these changes.

Even so, try winning that battle in court, on thing the prosecutors frown on is people who park in handicapped spaces. There is no reason for doing that.

In NC you can still get a ticket.

As long as it's been clearly marked as handicapped (whether it's by a sign, the symbol painted in the parking spot, or the outline of the spot painted blue) it is illegal to park there without a permit.

There's a lot of very judgemental people here...

Just because a parking spot has the wheelchair symbol painted on the ground, if a blue sign is not directly in front of the spot, then it is not considered a handicapped spot according to just about every city ordinance I've ever encountered. For all you know, the sign could have been removed due to an upcoming reconfiguring and re-painting of the parking lot.

The OP was asking if it's legal to park in a spot if the sign is not there. And the answer is yes, it is legal.

If there are no parking spots (even if marked on the ground) with an ADA-approved placard posted in front of them, then the land lord is in violation of city ordinance and is liable to receive some hefty fines.

All that being said, if the parking lot is empty, why even bother picking a handicapped spot, whether the sign is there or not?

Some years ago a young 7 year old made this remark to me:

He said, that those hadicap parking area are for nothing,

Who's gona park his wheelchair there!

But the law says NO PARKING UNDER ANY CIRCUMSTANCES.
