Possible to sue Ford?

Well we got into a car accident (not our fault...seriously) and the airbags did not deploy. Was wondering if it is possible to sue Ford for that? If we were going 10-15 mph faster we would of probably been seriously injured.

The car is a 2005 Ford Escape.

You could try to sue them but unless someone got hurt really bad I don't think that much will happen. I guess it wouldn't hurt to try.

Without knowing the situation, I'm trying to wonder how the accident wasn't your fault with the front end shoved in like that How fast were you moving? I think the airbags don't deploy unless you're going above a certain speed, like 25 or 30 MPH. Either way, glad to hear you're alright and you all escaped without serious injury! A toast to your safety

Well...
1) The airbag light is on in the dash...
2) We were going 60mph on the Long Island Expressway.
3) We were around 40ft behind a jeep cruising in the fast lane. Some lady cut off the jeep and suddenly stopped short with no one ahead of her. He rear ended her, we rear ended him. I am thinking Insurance Fraud? Her car was a POS, the jeep and my uncles car WERE in mint condition.

Sorry but thats your fault. Though the airbags should have deployed though that might not be a fault of Ford.

The car had a clean record and never been in any kind of accident... not even a fender bender. And he bought it BRAND NEW.

Insurance fraud wouldn't surprise me if the car in the lead just slammed on their brakes like that.

Key words: Follwing 40 ft behind a car moving 60 mph. If you had been keeping proper following distance you wouldn't have had an issue. Glad everyone is ok though.

Were you injured at all? If not, you are probably lucky the airbags didn't deploy. The deployment could have injured you more than the actual crash. BTW, I don't think you will have a case if you sue Ford. I'm pretty sure the airbag sensors are behind the front bumper. In comparison to the hood, the bumper barely got hit.

If you aren't injured and you're declared at-fault, don't sue.

Definitely have them look at the airbag when it's being repaired, although it's possible the bumper didn't take enough damage to trigger the sensor.

I have had a chevy and ford that failed to deploy the airbag in a crash.

It amazed me actually.

The ford was a 90 mustang where a guy turned right into me. Wasn't that bad so I could see why the airbag didn't deploy.

The Chevy was a 2001 S-10. The wreck was bad. Moved the engine back about a foot. Enough so that after the wreck was over the floorboard had met my pedals and actually pushed/bent them upwards. Snapped the driveshaft. I mean it was a pretty serious wreck. I could not believe the airbag failed to deploy in that one.

Sue for what? Were you injured badly because they didn't deploy?

If not, then why would you sue them?
