I've scanned a lot and I've read a lot, everyone keeps after the dealer, but they not saying much about the employee. He is still responsible for his actions, he drove the car outside of the scope of his employment, therefore he should have to pay restitution to the owner, he would probably have to be sued, but a court order garnishing his wages would be a good probability. If he has to go to court for his crime the judge should order restitution to the car owner.

Do not know you sir or your wife. Read your story and am beside my self. What is going on in that state any way. I'm here in S. Orygone. I have this story in the hands of National Talk Show Host, (and yes I have been to his house for dinner.) Let's just hope that his producers find it "Air Worthy" Beyond that point I have, and will continue to call the Dealership Until I get a response. Tomorrow: Monday morning I'm starting with GM in Detroit. If we would all do the same You should be covered in no time. Your Insurance has as much to do with this situation as the price of milk in Mexico City. It is an Internet world, this little Dealer needs to find that out.
If you wish to reply please send a PM. I M a DODGE / Benz Person & will not monitor. Don't get me wrong I Loved My 76 Monte Carlo, the 89 S-10 POS!.

I couldn't live like that, I'm not a bum, so I would have it taken care of as soon as I could so I could continue with my life and not have that hanging over my head and holding me back from the finer things in life. Like MY CAMARO

You must have missed a few posts that stated GM is aware of the situation and I'm sure they are doing what they can to help resolve this situation. See post #933.
Dealer Pays GM for the Right To Sell Their Product GM Pays Dealer For Warranty Work Do any of you really believe it takes 3.8 hours to replace a headlight switch, and that turns into all day for Us a Working Folks!

Absolutely! EVERYONE is very lucky that there was no loss of life. That was a blessing, perhaps a miracle. If there had been do you think for one second that a good atty would not have included that dealership in the lawsuit that would have followed. Ponder that for a moment. Yea, they are just cars and can be replaced. Definately worth keeping in perspective. But the dealership is in a customer service business. If they want people to entrust them with their cars, those customers need to feel confident they are handling those cars with great respect & care and that they will deal with any damage that is caused to them while in their care.
At this point, I am not worried. I think the OP is going to be fine.

What the heck kind of business do you run? (other than the church) What I posted was a sarcastic joke of course but 'Risk Management' does NOT stop something like this from happening. What you are REALLY talking about is to put it in the budget for a rainy day after you do what you can to prevent it from an SOP standpoint. Doing the right thing is easy for a business most of the time. Some choose NOT to. You'd have that choice taken away from them. And that's your philosophy, I can not say it's the wrong one cause it's yours. Mine is MUCH different. This dealership is on the legal hook to replace this guys car for it's value. I'm with you on that. (if they actually did give the guy a key to go get his phone) But anything above that should be the dealers choice. PERIOD. We should never be FORCED to do 'the right' thing. I just marvel at how everyone thinks that they should be able to dictate what's right according to them. But I'm curious what type of Risk Management you think would keep these wolves from asking way more than the value? If you think you can prevent these things from happening all together then you've never owned a real business. Not for any amount of time anyway. It's interesting to watch how people act with other peoples money. If it doesn't affect you then you don't care. And that's fine, that's your choice. But to punish someone for something they did not intend is typical of todays mindset. I have no doubt that you'd still be on a jury and make this guy buy a new car even if it were a fire or unavoidable incident so it's really semantics. |

Just explain to me if the guy had stole the car , and had never been nabbed , the OP will get nothing back right Assuming that the OP didn't have his insurance policy valid for stolen propriety ? Are you sure you want this to happen to you next time you take you car in for service ? |
