Wow....that sucks. A lot. However...all GM has to do is document that ANY modification was made from the factory specs, to a failed system, and that will void your warranty. Its pretty common knowledge that anytime you make any modification while your car is under warranty...you take the chance of losing coverage. Apparently the dealer you took it to wasnt working in your best interest. They clearly took pictures to document the modifications, and didnt give you a heads up to return it to stock. Elite my ass....more like screw you customer and then lie to you.
Frankly, even if you took them to court, AND you can make the case that the modifications had nothing to do with the failure (which they clearly did not), doesnt matter......just the fact that you made the modifications is enough for them to deny warranty on the drivetrain. You should still be covered on all the other systems in the car (ie you cant be denied coverage on your myLink, for the catch can), but the engine, possibly the trans and rear axle are now not covered. Hate to be the guy that pisses in your punchbowl, but Ive dealt with the legal side of these things for a long time.....and you dont have a legal case, even if you have a technical one. Only thing to do now....is pull the motor and build yourself a nice forged stroker

I spent about $6000 replacing the 2.0T engine in my Cadillac ATS. Had a downpipe and tune installed. one day it began running rough, so not thinking it was anything serious i dropped it off at the dealer. Turns out there was a hole in one of the pistons, and warranty replacement refused because of modifications. Two weeks of fighting, BBB meetings, numerous calls, it didnt matter. Even the BBB took the side of GM.
Have the car fixed out of pocket, keep all receipts then take it to the BBB. They will offer you half the cost. TAKE IT. I didnt because i thought i had a case.

The OP's post was extremely long but did I miss the part where he said the engine is ruined? I thought he only suspected an issue with the oil pump? If only the pump needs replacing at this point, it seems practical for the OP to pay to fix it now and then sue to recover the costs of the repairs. This way he'll get his car back ASAP.

Get a lawyer. you NEED to at LEAST SPEAK to a lawyer. The people on this forum do not have law degrees. I have been through this and know several who have, every single case was settled out of court to the paintiff's satisfaction. If everything is as YOU say and they aren't claiming the Air Intake was faulty instead, this is an open and shut case. Do not stop to collect $200.00 do not talk to anyone else, do not make any decisions until you have consulted an attorney. |
