The real problem is that they did try several times to get a hold of you and no response. In my construction company, if I called my client 30 times and they didn't call back, I would give up and go on to the next client.
Did you inform them you were going on vacation?

It seems to me that they should have given you the opportunity to resolve the credit issue, if there was a credit issue at all. You should have had the opportunity to put more money down, find a co-signer, find a lender, etc. We don't have all the details but you may have a case, If so, do NOT let the bastards off the hook.

Please try DMV. They can close a dealership. When had a problem with a dealership i filed the paper work with DMV and in one day the dealership was call to fix the problem.

FbodFather can't help with this one since the car has been sold. If they take it back from the person they sold it to (ehich they can't do) they will get sued. Since they sold his car out from under him they should get sued by him. They are really screwed here and are banking on the fact that you wont hire an attorney. I would get an attorney today if you can. A strongly worded letter can do wonders. They have to give you the opprutunity to buy the car. Even if your financing fell through through them you should be allowed reasonable time to setup private financing. Considering you wern't even in town at the time they failed to do this.

Bottom line is you have a string case against this dealer and I would call the DMV, State Attorney General and a lawyer. Letting FBodFather know as well couldn't hurt as I am sure he will be furious when he hears this.

there are MSRP dealers only a few miles away, why pay 5-10k more? Might as well buy a Corvette for that mark up

Yeah, we need to hear more about these 30 phone calls. If they indeed called you many times and could not get a hold of you, then I really don't know what to tell you. However, it could very well be BS that they were trying to get a hold of you. Were they aware of you going to Texas and did they have all avenues of how to get a hold of you? Email, cellphone.
