Upflying, in florida i've heard of people getting into trouble for damaging their own property, one story comes to mind of a woman who threw a brick through her own car window because she was pissed. well she ended up on probation for it if i remember right, that or anger management or both. but then again idc, if i bought it i can break it. not a woman, a gf, or a wife less she wants to get left.

Ca is a community property state. If you are married, the object equally belongs to both regardless of who bought it. Just saying you are entitled to vandalize your own property if you so desire. Could be different in FL.
No way would cops arrest someone for trashing their own car.
Doesn't mean the person won't get hooked up for a psychiatric evaluation.

There are instances of people being arrested for destruction of their own personal property during the course of an argument. And when it causes a disturbance. Or in some cases when there is a lienholder on the item. Since you don't actually own it yet your destroying the banks property. Many mortgage docs have clauses such as these in them.

Why is he in jail and not her?
She broke his property and damaged his. All he did was point a gun at her. Didnt hurt or nothing..
Then they keep saying she is pregnant so you feel sympathetic toward her. News twist everything.. Cops should of showed up told her well we didnt see him do that and your not shot. The gun isnt loaded. But we do see this damage to that fine automobile. We taking you away

I agree the bank may be the lien holder but that is civil law not criminal law. Cops can't arrest for violation of a civil law.
If there is an instance of someone arrested for destroying their own property, that's news to me.
Attached is California's vandalism law. To have a crime, it has to be property that does not belong to you.

594. (a) Every person who maliciously commits any of the following acts with respect to any real or personal property not his or her own, in cases other than those specified by state law, is guilty of vandalism: (1) Defaces with graffiti or other inscribed material. (2) Damages. (3) Destroys. Whenever a person violates this subdivision with respect to real property, vehicles, signs, fixtures, furnishings, or property belonging to any public entity, as defined by Section 811.2 of the Government Code, or the federal government, it shall be a permissive inference that the person neither owned the property nor had the permission of the owner to deface, damage, or destroy the property.

According to the article he admitted to the police that he pointed the weapon, which was admitting he broke the law. She broke no laws, although some of us disagree with the law.

He's the bigger idiot, never tell the cops anything. So many people get arrested for telling on themselves.

Yup, im sure she diddnt know it wasnt loaded. Then to her perception her life was in danger and he was ready to use deadly force, so therefore he can be charged with deadly force. The law is 90% perception.

Back to the matter, hes an idiot for not leaving, shes a dumb bitch for actiong the way she did and not leaving. They shouldnt be arrested just have some sense smacked into them... then again she is preg Im sure them hormones are amazingly outa wack lol
