Dealer Parts Department bait and switch?

Here's the situation:

Purchased a part online through NalleyGMC.com. Order was processed, money taken out of my account, and I assumed part would be shipped.

Then the parts department calls me and tells me the part# has been superseded and they will now need more $$$. And, they tell me the reason they aren't liable to honor the price I already PAID, is because GM doesn't tell them when they supersede their part numbers so they have no way of knowing until they try to ship the part.

WTF??

IT'S THE SAME DAMN PART! The only thing that changed was the part # and the price!


Not trying to rant exactly, but rather I'm trying to see if I have a legit case of a bait and switch?

My feeling is that I should get the part for the price that I already paid! The part was ordered, processed, and paid for. They listed the part as being in stock (or at least able to be ordered)... I fail to see how it's my fault that the part was superseded and now costs more $$$.

Is my only recourse would be to file a BBB complaint?

They already refunded me my money.. but still.. I think this is pure BS.

I agree, that was lousy. They SHOULD have honored your order. However, since they refunded your money, there's not really any foul to call them on, legally. I agree that it sucks though.... sounds like bait and switch, but hard to prove, and impossible to prove damages.

I agree with that.. they should have honored my order and then changed their process to resolve the issue.. they shouldn't have made it to be my issue.

The cost of the part wouldn't be enough to get involved legally anyway.. even if I had a fully winnable case that was open and shut..

Just pisses me off.

While I was attending university, I worked at a parts store. Sometimes, the price listing the company paid for did not account for the most recently superseded parts. Typically, the company insisted that patrons wait until the order came in before pricing the part to them. However, if they insisted on paying up front and we found out during the ordering process, we would typically call the customer and tell them about the discrepancy.

Sometimes eating a few cents can be good business. However, in my experience, there were occasions where the $2 part my customer wanted became a $100 assembly due to engineering design changes. I worked for a small company, and we always made sure these discrepancies were handled before ordering.

Maybe this isn't helpful to you, but sometimes it is good to see the other side of the fence.

It's not Bait and Switch by no means. They did the right thing, by calling you. Also I can just about guarantee, that somewhere on their site is a disclaimer about pricing. Sorry about getting pissed, but you have no reason to.

It'd be one thing if they told me about the discrepancy BEFORE charging my account for the $$$ and sending me email that the order is being processed and will be shipped in 3 days.

Taking funds from an account is immediate.. submitting a reversal/refund takes 3 - 4 business days to hit my account.

oh well.. water under the bridge I suppose.

The pitfalls of online buying. This has become very common in many parts, and not just in the auto industry. The dealer did correct calling you, assume upon they probably processing the online request, the dealership person doing the processing, discovering the change, then called you.

Try another source.

But.....

If this dealer didn't call in in less than 2 days time from online order? They suck!
If this dealer online parts order screen still shows this part to order? Again, they suck!
