Strange problem maybe related to drive by wire

So under a constant throttle position lets say 15% while accelerating slightly through 1st then 2nd gear the power is changing like I am pushing the pedal down more then lifting and repeating. Like its pushing me back in the seat a little then it stops then its pushing me back again. All with a constant throttle position. Is this the newer style drive by wire I guess it's called vs. the old throttle cable issue ? I would like to get any issues taken care of before I ruin my warranty by modding the car. It currently has 750 miles on it. The problem doesn't seem to be as noticeable once the car warms up.
Thanks

p.s. I do have the vitesse throttle controller but I have not installed it yet. I'm sure if I did the dealer would blame it on that.

Yes, like you said, don't install the Vitesse Controller until you get your issue resolved. Sounds like a faulty Throttle Position sensor or the accelerator pedal Sensor going bad.
