Hard to look at these pictures....
Glad your ok. I think your stuck have them repair it. Just pick a good shop and stay on them for OEM parts.

I have some pretty bad whiplash / neck and upper back issues. I always have somewhat looked down on people who complain so much after getting rear ended but now almost 2 weeks later I can genuinely say that it SUCKS and i'm in a lot of pain! Not to mention I likely got a concussion too - haven't been in the gym since the accident and I can barely sleep - and i'm a perfectly healthy dude in really good shape. AND I can't ride my brand new Panigale 1299 which has been sitting in the garage giving me dirty looks for not touching her.
I really appreciate everyone's input - I think I'm going to have the thing fixed back to glory and move on. I trust the body shop I have it in and USAA to take care of it. Now as far as the diminished value claim, does anyone have any experience with that? Also, they are trying to pull the rear subframe and not replace it, but repair it. Would it make more sense to ask for a full replacement? |

I don't have direct experience with dimished value claims, but I'm sure someone here will chime in with more detail.
A coworker of mine was t-boned by someone who ran a red light in her new Murano, and filed a diminished value claim with the person at faults insurance. She said it was fairly easy and got a few grand out of it on top of getting her car fixed. I'd start with your insurance company and ask what you need to do to file a claim. Good luck! |

USAA is very good at repairing your car, they have preferred body shops that provide a life time warranty With the repairs. (Any issues down the road the body shop has to fix it or lose preferred status with USAA you don't pay another deductable). Document in great detail the damages and repair process with pictures or notes however you wish. Keep all the bent parts fasteners etc. EVERYTHING if it came off the car and a new part was added you want the old part. If you end up selling the new owner won't be so focus on the car fax report because you have lifetime warrenty (not sure if that transfers to owner or not), all the bent sheet metal and the receipt for repairs, he will know that all the repairs are correct.
Good luck and be patience. If you use a GM body shop make its the corvette tech that works on it a bottle Crown goes a long way to the body man too. Just my 2 cents, I wish you all the luck and I know this sucks.

I explored diminished value when I was rear ended in an almost new vehicle. I did not go though because we determined the amount I would get wasn't going to be that big. I think you have a different case.
First off, you'll likely need to go after the other insurance company, not yours for it. You'll need to prove your car is worth less now than it was before. There are several ways to do this. There are some cheap online places, and probably some more expensive local places that will write up a full report of the value and reasons for the change in value. You may be able to do this yourself by going to a few dealers and such. I disagree with elsolo (would you buy it for the same price post repair, even a perfect repair as an undamaged car?). Your car has frame damage and dealers won't even touch it in a resale. It's also a small volume limitted use car, not a daily driver honda civic. You'll probably need to go round-and-round with the insurance company, but claims are paid. |

Sorry to hear of your loss. I would get it fixed, and then trade for a new ZL (if your finances will permit it). If you cannot unload it now, then wait a few years for the 6th gen ZL. You can, of course, keep it if its fixed to a perfect standard (but knowing me I wouldn't be able to stand the car after its ruined from a rear ender).

Fix it and drive it. After 3-4 years, this "frame" damage will only make $1-2K difference on a trade in.
If you sell it the way it is right now, you'll get pennies on a dollar. |

Get a good lawyer and tell him about the car fax problem , he will sue the other insurance company and get you paid for the devaluation of the car fax report. A good Lawyer will get you all you enough $$$$$$$$$$$$ to make you forget the whole thing.

I also am advising to lawyer up immediately. I also advise ANYONE involved in an motor vehicle accident and have neck or back pain, GO TO THE EMERGENCY ROOM! Many years ago in my other life as a Firefighter/Paramedic, we transported a gentleman who had an accident with another vehicle. We arrived on scene and noted he was out walking and talking but complaining of pain in his neck. Not real bad but sore. I had noticed the impact had caused him to vomit. We all know if you hit that damn hard and throw up there was a violent impact involved. I placed him in cervical spine precautions just because something wasn't right. We were told the next shift he had fractured C-5. The moral of the story is he said he felt fine and was walking around normally. The scary truth is that those vertebra C-3,C-4, and the fore mentioned C-5 "keep the body alive". The same ones fractured in a hangman's noose.

Word of advice: HIRE AN ATTORNEY AND DEMAND A TOTAL LOSS! If there is ANY frame damage, an attorney will get it totaled no problem. Last year I was in the same exact situation with my Lexus (hit from rear by girl texting)....Best I could get on my own (before I called my high $$$ B-I-L attorney) was damaged fixed, $1500.00 Pain/suffering and medical stopped the second I signed the check....Enter my brother in law at $1100 an hour, car totaled and MAXIMUM value of policy was paid to me for P/S....So one phone call to an attorney netted $67,000 more than I could get on my own.
