The only time a tune comes into question is when people go way aggressive, don't know what they are doing- run the lean and detonate the shit out of them.

Re-read the warranty. You can sue anyone you want, but the warranty is pretty clear. It can backfire though- someone tried it over an Audi that he tuned himself and my testimony destroyed him in court.
Best advice is to form a relationship with your dealer- they can be your best ally in a case like that. Not all dealerships are evil. The ones who are honest about what they did to the car are always the best ones to deal with. Every one of 'em who goes the legal route usually started off on a bad foot with not being honest and letting us help him. Just because they don't like the result of having to pay for what they broke often leads to the whole 'mountain out of a mole hill" thing.

fixed ops director at a chevy dealer now- I've done consulting work for many companies including Land Rover, Audi, VW etc.

Why would someone choose to run over-lean? Is it to save on gas or does it have something to do with creating more HP. Sorry if it's a dumb question.

Going lean is easy to do and VERY destructive. Going too rich won't send you in to a shop for a new engine. If you port the heads, intake etc and increase airflow and not fuel- bad things can happen.
