I really hope that deposit was refundable. Did you sign any paperwork? Did the dealership know that you didn't have the financing in order? I just don't see them letting you take the car for two weeks if funding wasn't a done deal. Unless of course it's in writing that the deposit is non refundable, in which they would have nothing to lose really, and $5K to gain.

When I worked at a dealership, we called it grounding someone in the vehicle. You put them in the car, to keep them from shopping with 5K to put down elsewhere. We would give them a 5 day drive out tag. Sometimes a lender will come back and want additional money down or select a less expensive vehicle.

This could happen, especially if he was less than truthful on the credit application. He may have overstated his income or understated his debts which made it look like he would have qualified for the loan but once the finance company checked further found that he did not.
